Harsh flays Election Authority for misleading remarks ‘BDCs polls’ | | | EARLY TIMES REPORT Jammu Nov 22: Harsh Dev Singh NPP MLA and its working chairman has flayed the State Election Authority for its highly misleading and erroneous statement made to the Press regarding the Elections to Block Development councils (BDCs) in the State. He said that the statement has been made in a casual, clandestine manner without going through the provisions of the Panchayati Raj Act. He said that the said statement of Election Authority, while making a reference to the early constitution of 143 Block Development Councils in the State says that any person eligible to be elected as MLA can join the fray for election to the post of Chairman of Block Development council. “The statement as appeared in local English daily on Nov 18, says that “any one can contest the election if he fulfilled the criteria listed for election of Assembly in the Representation of People Act”, added Singh. Describing the statement as highly irresponsible, illogical and ill-conceived, Singh said that it had conveyed misleading and confusing signals across the State. He said that the legal position on the subject was altogether different and perhaps the statement had been issued without going through the relevant provisions of the Act on the subject. He also said that statement had created a lot of confusion in political circles with regard to the appropriate qualifications and eligibility criteria for the purpose of election of Chairman of BDCs and constitution of such councils. Elaborating further on the subject, Harsh Dev Singh said that the procedure and eligibility criteria for election of Chairman of Block Development Councils had been laid down in Sec 28 of the Panchayati Raj Act which categorically states that “every Block Development Council shall have a Chairman who shall be a person qualified to be elected as a Panch…….”. He further added that Sec 6 of the Panchayati Raj Act laid down that a person shall be eligible to be a Panch if his name is included in the electoral rolls of such halqa Panchayat. He said that the net effect of the legal provisions as contained in the Panchayat Raj Act was that a person in order to be Chairman of BDC ought to be eligible for election as a Panch with his name appearing in any of the electoral rolls of the halqa Panchayats comprising the respective Block Development Council. He advised the State Election Deptt which was a highly responsible and respectable institution, to refrain from issuing such confusing and mis-leading statements which could lead to serious ramifications.
