Spl Court CBI awarded one year imprisonment and fine to then Manager IRCON

Jammu, Nov 23: Special Judge Anticorruption of Special Court for CBI Cases J&K today in its first judgment awarded one year imprisonment and fine Rs 10,000 to the then Manager IRCON international limited Banihal who was caught red-handed by a team of CBI on June 12, 2007 while accepting Rs 15000/- as bribe from the complainant contractor as enticement.
Special Judge Anticorruption for CBI Cases B L Bhat after hearing Special PP for CBI, S K Bhat observed that the issue of Sanction for prosecution, the court deem it appropriate to observe that absence of omission in or any defect or error in an order of sanction for prosecution is no longer statutorily recognized as a ground to reverse any finding, judgment conviction or sentence by an Appellate or Revisional Court unless the same is found to have occasioned failure of justice. BL Bhat Special Judge Anticorruption of Special Court for CBI Cases J&K today in its first judgment awarded one year imprisonment and fine Rs 10,000 to Vinod Kumar then Manager IRCON international limited Banihal who was caught red-handed by a team of CBI on June 12, 2007 when accused demanded and accepted Rs 15000/- as bribe from the complainant contractor. The substantive sentences of imprisonment shall run concurrently. The amount of fine be deposited within thirty days failing which the same shall be realized from the estate of accused.
A case FIR No.7(A)/2007-CBI/Jammu was registered in CBI Jammu on 12-06-2007 U/s 161 against Vinod Kumar, the then Manager, IRCON International Limited Banihal with the allegations that he has demanded Rs. 50,000/- from the complainant. A Judgement was delivered today on 23-11-2011 and accused has been lodged in the Distt Jail Jammu.
According to the case one complainant Nehal Singh of Digdool, Tehsil & Disttt, Ramban alleged that Vinod Kumar has threatened him that in case of non-payment of Rs. 1,00,000/-, the accused Vinod Kumar would not allot any other work to the complainant. However on negotiations, Vinod Kumar has asked the complainant to pay Rs. 15,000/- and remaining later on when new work is given, the case said.
In order to catch the accused red handed while accepting illegal gratification, a team led by K L Raina, the then Addl SP (Now Head Srinagar CBI Branch) was formed to catch the accused Vinod Kumar.
