2 persons awarded simple imprisonment for 3 month

JAMMU, Nov 24: Judicial Magistrate Ist Class Kathua Aarti Mohan Convicted accused persons namely Rattan Chand son of Mehar Chand and Koushal Kumar son of Rattan Chand both residents of Gatti Tehsil Bani District Kathua to undergo simple imprisonment for three months and fine of Rs.500 each for commission of offence under section 353 RPC today.
Judicial Magistrate Ist Class Kathua Aarti Mohan pronounced her verdict in case titled State versus Rattan Chand and others in a case FIR No. 32/2007 of Police Station Bani. Reports said that , on 20.11.2010 a written complaint was made by Assistant Commandant CISF on a complaint of Constable Vinod Kumar wherein he had stated that on 21.08.2007 he was on duty from 01 PM to 09 PM at NHPC Sewa II Dam check post. At 08. 05 PM a Bus with employees of night shift of Gammon India arrived.
He was checking the gate pass of labour when accused Rattan Chand who is a peon at Gammon India started crossing the barrier without showing his gate pass and when the complainant Vinod Kumar asked him to show his gate pass he started arguing with him and caught his collar and torned the buttons of his uniform and at that time his son accused Kousal Kumar also came there and both started beating him and also tried to snatch his AK-47. On this written application of Assistant Commandant CISF FIR No.32/2007 U/S 353 RPC was registered in police station Bani and after completion of investigation chargesheet was presented in the court.
After hearing the Prosecuting Officer Ravinder Paul Singh appearing for the State and Counsel for accused namely Advocate Dilawar singh Honble Court convicted the accused persons namely Rattan Chand son of Mehar Chand and Koushal Kumar son of Rattan Chand both residents of Gatti Tehsil Bani District Kathua to undergo simple imprisonment for three months and fine of Rs.500/- each for commission of offence under section 353 RPC.
