In Bhaderwah town Pakistani family has more civic rights than a local family

Jammu, Nov 26:- The local administration in Bhaderwah town of Doda district in Jammu and Kashmir is silent over why they fail to take action against a family that actually hails from Pakistan and has illegally transgressed into the state and grabbed the land of a person who is a permanent resident of the state.
This is the woeful tail of Ali Asgar Khan of Mohalla Havelli Bhaderwah, whose land was grabbed by a Pakistani family that virtually threw him out of his own land with the help of some locals. This shows how a Pakistani family enjoys more civic rights than a local family.
According to Asgar Ali Khan he possesses a good deal of ancestral land bearing Khasra numbers 1696 and 1697 (Min) and among the two land pieces, whole land under Khasra number 1696 belongs to him, where as he is the co-share owner (70%) of land under Khasra number 1697 (Min) measuring 3 Marlas.
It was in the year 1991, when a person namely Ghulam Hussain Sheikh alias Gandhi S/O Chirag Din Gandhi actually a resident of Sukochek area of District Sialkot of Pakistan grabbed his land under Khasra number 1697(min).
The said Ghulam Hussain Gandhi (Pakistani National), who entered into Bhaderwah town in late 80's along with his son Khurshid Hussain Gandhi as a vendor, grabbed the piece of land and started construction of a house in the aforesaid piece of land without prior permission from the concerned authority, Municipal Committee Bhadarwah(MCB) and the revenue authorities.
Even though the family approach the appropriate forum for action against Ghulam Hussain Gandhi, all the authorities from time to time turned a blind eye towards the issue as a result of which he (Gandhi) get encouraged and become more rigid and started further harassing the said family and even put a verandah and fall of the roof in to the adjacent land of Ali Asgar Khan and also raised illegally a staircase in the midst of the common thoroughfare.
Asgar said despite repeated requests the said persons continuously restored to unlawful acts. He said that after getting dejected due to non delivery of Justice, his family approached Suhanshu Panday (IAS) who was Sub-Divisional Magistrate Bhadarwah and Chairman BMC Bhaderwah in the year 1999 at the time when Gandhi and his family grabbed his land. He said that Pandey after verifying the fact order for immediate stopping of illegal construction of house of Ghulam Hussain Gandhi. Succumbing to the pressure, Ghulam Hussain Gandi in written affidavit before Hon'ble Sub-Judge Court Bhadarwah in the year 1991, gave written undertaking that he will not violate the rules and regulations and that in future there would be no right of his or any of his family member on the said land and no construction would be resorted. The affidavit was duly authenticated by the Judicial magistrate in presence of witnesses, but despite written undertaking before the court, Ghulam Hussain Gandhi did not bother and continued his illegal construction of the house over the land grabbed by him illegally. He said that he and his family continuously approached different forums from time to time, but no one either in police department or in administration gives relief to me and my family.
With the onset of the militancy in Jammu and Kashmir Bhadarwah like other parts of the state also becomes the hub of militancy related activities and during this period the matter could not be solved properly. The suffer family received a big jolt when militants on 21st July 1999 killed the younger son of Ali Asgar Khan. In this attack the daughter of Khan also got injured, while other family members had a narrow escape. In the year 2002, Khan Family was attacked by the militants 2nd time, but the timely action of the security forces saved the life of Ali Asgar Khan and his family members. Later security forces arrested Khurshid Hussain Gandhi @ Mujahid Hussain@ Mujahid Khurshid and it was during his interrogation in JIC at Jammu, Khurshid spilled the beans about the attack on Khan's family and admitted his crime and also nominated his other accomplices who were behind this attack. After this the then Home Minister of the state and Higher Police authorities also ordered high level inquiry in to the episode of attack, but he was soon released from the jail, the reason of which is still unknown despite the fact that both police and administration have full knowledge about the nationality of Khurshid Gandhi. Ghulam Hussain Gandhi not only managed to construct his house on grabbed land, but despite being a Pakistani national manage the permanent job for his son Khurshid Gandhi in Forest department.
