Govt can transfers its employees to Autonomous Body: HC | | | EARLY TIMES REPORT Jammu, Nov 28 J&K High Court Jammu Wing in a petition challenging the transfer of Bodh Raj to SKUAST as Incharge Deputy Comptroller observed State Govt can transfer services of its employees to Autonomous Body only with the latter’s consent and not otherwise. It allowed the petition and quashed Govt order NO 365-F of 2006 whereby Bodh Raj was posted as Incharge Deputy Comptroller SKUAST. Justice JP Singh of J&K High Court Jammu Wing in a petition filed by one Sohan Lal Sharma challenging the transfer of Bodh Raj to SKUAST as Incharge Deputy Comptroller, quashed Govt order NO 365-F of 2006 whereby Bodh Raj was posted as Incharge Deputy Comptroller SKUAST. Justice JP Singh after hearing Adv Rahul Pant appearing for the petitioner observed that University’s response to the petition reveals that it had informed State Govt about its unwillingness to accept Bodh Raj in the university. Already High Court stayed the transfer order of Bodh Raj, Court further observed that the State Govt can transfer services of its employees to Autonomous Body only with the latter’s consent and not otherwise. In this view of the matter the services of Bodh Raj respondents could not be transferred to the University without its consent which is stated to have been specifically refused and quashed the Govt order No 365-F 2006.
