Court awards 10 years RI, fine to Charas Smuggler | | | EARLY TIMES REPORT Jammu, November-30 (JNF):- Principal Sessions Judge Ramban Mr. MA Chowdhary awarded 10 years Rigorous imprisonment and fine Rs 1 lac to Charas Muggler Jamal Din s/o Ghulam Hajam r/o Kahri Tehsil Banihal. According to the police case on January 24, 2008 one ASI Ghulam Mohd Runyal from camp wagon sent a report to police station that he was accompanied by follower Sher Singh & other officials was on patrol duty at Banihal market and Wagon and a person was found keeping both arms under the pheran and was proceeding towards Banihal on foot. He was stooped and on enquiry he disclosed his identity as Jamal Din. He was searched and two polythene bags were recovered from him one containing 11 pieces of the maize wraps containing charas and the other containing charas in form of powder. On this police registered a case under NDPS ACT and after completion of investigation challan was presented in the Court.
While awarding sentence to the accused, the court observed that the facts and circumstances of the case particularly the young age of the accused and his rural and poor back ground when he has all chances of reformation are extenuating and mitigating circumstances to justify for imposition of lesser sentence. Court is of the considered opinion that, the interest of justice shall be served with the imposition of the minimum sentence. The accused is thus sentenced to rigorous imprisonment for a period of ten years and a fine Rs one lakh under section 2
