PSA of two alleged Bovine Smugglers quashed | | | EARLY TIMES REPORT Jammu, Dec 1: J&K High Court Jammu Wing today quashed the detention of two persons allegedly involved in bovine smuggling and been detained under Public Safety Act by the order of District Magistrate Kathua on June 27, 2011 which was challenged by both the petitioners. Justice J P Singh of J&K High Court Jammu Wing today quashed the detention order of Nazir Ahmed and Roshan Din after hearing father of the detenue appear in person and AAG Gagan Basotra observed that District Magistrate Kathua had directed Nazir Ahmed’s detention to prevent from indulging in criminal activities which are considered pre-judicial and detrimental to the maintenance of public order. Court further observed that the grounds of detention do not indicate any thing about petitioner’s activities after his last objectionable activity of May 11, 2009 when case was registered against him at P/S Raj Bagh. The District Magistrate being unaware about detenue’s recent activities has acted illegal in curtailing detenue’s liberty on the basis of alleged activities of 2006, 2008 & 2009. With these observations Court quashed the order of District Magistrate Kathua dated June 27, 2011 and directed the authority to set the petitioner to liberty forthwith unless required in any other case. Court in another habeas corpus petition filed by Roshan Din through his father, Justice JP Singh after hearing father of the detenue appear in person and Deputy AG BR Chandan quashed the detention order of Roshan Din passed by District Magistrate Kathua on June 27, 2011.
