HC dismissed petition seeking quashment of Charge

Jammu, Dec 02: In much publicized Narwal Double Murder case in which six accused are facing trial and the Trial Court framed charges against three accused and dismissed both the petitions u/s 561-A CrPC and bail application.
Justice Mansoor Ahmed Mir of Jammu & Kashmir High Court Jammu Wing today decided both the petitions filed by Ranjodh Singh @ Nalwa and Narinder Singh seeking quashment framing charge against them disposed of the bail applications.
Court observed that ground projected by the accused Ranjodh Singh for seeking bail is based on his health condition. “But in the instant case, the accused-Ranjodh Singh was taken to Sheri Kashmir Institute of Medical Sciences (SKIMS) Srinagar, at the expense of the State and even the post operative management was also borne by the State. He has been taken by air to Srinagar for obtaining the medical advise/ opinion and on this count the State has not only paid the Air Fare of the accused but of those officials also under whose custody and security he was, court said. It further said that therefore the question of State being negligent in taking care of the health of the accused during custody does not arise.
In this regard report submitted by Dr Altaf Umer Ramzan Additional Professor & head Dept of Neurosurgery, SKIMS needs a look. In the given circumstances respondents are directed to shift the accused Ranjodh Singh in the Police Hospital at Jammu for the period as would suffice the medical advice and thereafter be shifted back to Central Jail in terms of the orders of trial court. With these observations Court dismissed both the petitions u/s 561-A CrPC and Bail application is dismissed and bail application of Ranjodh Singh is disposed of.
According to the case that one Surinder Singh alias Kala s/o Isher Singh has deposed before the police on that on February 5, 2010 at about 5:30 PM Gurnam Singh brother and Rajinder Singh Maternal uncle were standing near the shop 104 whereas Devinder Singh alias Bunty, Gurvinder Pal Singh were also present there the complainant was also standing there, a car No 3812-JK02V came there and hit Rajinder Singh intentionally whereas Ajit Singh alias Kala, Milkha Singh, Jatinder Singh alias Kala, Paramjeet Singh alias Pummy, Jeeta driver of Milkha Singh came out from the car and started attack with sharp edge weapons and Danda, at this stage complainant raised alarm, all the five accused after seriously injured both deceased and ran away. Devinder Singh alias Bunty and Gurdyal Singh took the injured to GMC Jammu where doctor declared Gurnam Singh brought dead whereas later on Rajinder Singh also succumbed to injuries
