Lawyers up in arms against NC-Congress coalition | | | NEHA
JAMMU, Dec 9: The black-coated community of lawyers has been striking work for days now to draw the official attention to their demands but with no result. The government has refused to see reason. With the result, the judicial system stands paralysed and dysfunctional, thus adding to the woes of litigants or those seeking justice. Convinced that the NC-Congress coalition government might not concede their demands, President of the Bar Association, Jammu (BAJ) B S Slathia bemoaned yesterday the negative attitude and said: "in the absence of serious response from the Government towards the grievances of the lawyers community, we have decided to stage protest dharnas tomorrow", which they did hold and it was an impressive affair. The legal fraternity held protest dharnas in Reasi, Katra, Poonch, Rajouri, Samba, Kathua, Hiranagar, Ramban, Batote, Bhaderwah, Kishtwar, Doda, Udhampur, Bishnah, R S Pura, Akhnoor, Nowshera, Bhillawar, Bani, Majalata, Ramnagar, Chenani, Banihal and Thathri. The most significant aspect was the participation in the dharna of persons not connected with the legal profession. It happened, particularly in Jammu where persons not connected with the legal profession made common cause with the agitating legal fraternity. It needs to be noted that a number of political and other groups have come forward to extend their unqualified and un-stinted support to the protesting lawyers. The BJP has extended support to them. The Panthers Party has given the lawyers their fullest possible support. The Chamber of Commerce and Industry (CCI) under the leadership of its president Y B Sharma has come forward to support the lawyers' movement. Sharma said: "The Government move is tantamount to cause lot of inconvenience to general public and pleaded that the existing system should not be demolished and if need be, it should be properly improved by bringing in suitable modifications" and added that "judiciary and lawyers are important organs of the society rendering useful services and to take away their services in any way would create a chaotic situation". Significantly, the leadership of the displaced community of Kashmiri Hindus has not only extended its support to the lawyers' cause but it actually participated in the today's dharna, held in Jammu. The Muslim Federation, too, has extended support to the agitating lawyers. The fact of the matter is that all, barring the NC and the Congress, have made common cause with the legal profession and denounced the indifferent attitude of the state government towards their demands. What are the grievances of the legal fraternity in the state? Their main grievances are two. One, the decision of the NC-Congress coalition government to transfer registration powers to the executive officers. "If the registration powers are vested with executive officers, it will lead to a chaotic situation wherein the ultimate sufferer will be a common man…The public is already facing difficulties in extracting their revenue documents (Fard Intkhab, Inteqal etc) and the move of the government would further add to the plight and miseries of the common masses," the BAJ president says in this regard. Two, the decision of the government to deprive the legal fraternity of its share in the judicial services. It is extremely doubtful if the adamant NC-Congress coalition would redress the grievances of the agitating legal fraternity. This belief stems from the fact that both these organizations are arrogant and unaccommodating. It also stems from the fact that the NC-Congress government has not withdrawn its new job policy, which is inhuman and humiliating, despite massive protests in Jammu and largely-participated in student demonstrations in the educational institutions, including Jammu University. The lawyers must recognize the ground realities and act accordingly. It would be better if they demand and work for separate Jammu State. For, in separation lies their salvation as well as the salvation of the Jammu province, a victim of gross discrimination. They should remember that they and the people of Jammu province would get justice till they obtained a dispensation independent of Kashmir. |
