JAMMU, Dec 11:In a defamation case filed by a senior official of Jammu and Kashmir Academy of Art, Culture and Languages (JKAACL), a Jammu court ordered summon to be issued to GKS Malik (Gurjeet Malik) then Deputy Director, News, Radio Kashmir Srinagar to appear before the court in person on December 30.
The complainant, Dr Javaid Rahi, working as Chief Editor (Gojri) in Jammu and Kashmir Academy of Art, Culture and Languages, approached the court of Chief Judicial Magistrate, Jammu with a complaint under Section 500 RPC against GKS Malik (Gurjeet Malik) then deputy director (News) Radio Kashmir, Srinagar for defaming the complainant.
The complaint subsequently transferred to the court of Special Mobile Magistrate Electricity, Jammu by the CJM.
It was submitted in the complaint that the complainant was shocked and surprised over the circulation of a malicious letter written by the accused, which was addressed to Chief Minister. It was further submitted in the complaint that certain baseless, malicious and defamatory allegations were levelled by the accused against the complainant in the letter, circulated in Academy office with a malicious intent.”
The complaint further submitted, “Not only this, the accused even addressed this malicious letter to Secretary JKAACL and as such the reputation of the complainant has been lowered and tarnished there also.”
The complainant prayed that “action be taken against the accused for defaming his reputation.
Subsequently, after going through the complaint and hearing the counsel for complainant Advocates Sheikh Shakeel Ahmed, Kabir Ahmed Malik and Zulkarnain , the Judge Balbir Lal Jaswal, Special Mobile Magistrate, Electricity Jammu observed, "The content of the complaint and supporting material prima facie disclose the commission of the offence under section 500 RPC. At this stage cognizance is take under section 500.
Let the alleged accused be summoned to appear in the court in person on next date of hearing fixed on December 30.
