Bail application of Madan Lal Aggarwal rejected, sent to Jail | | | EARLY TIMES REPORT Jammu, Dec 12:3rd Additional Sessions Judge Jammu with the power Special Court Drugs & Cosmetic Act Sanjay Parhiar today dismissed the bail application of Madan Lal Aggarwal claim to be main trustee of Vishwa Swasth Dham Raghunath Bazaar Jammu where drugs were found stocked and taken in custody and sent him to Jail. Court after considering the arguments and the contents of the bail application observed that though the complaint does not dislocsed about he being engaged in production of adulterated or spurious drugs, but having regard to the mandate of section 36 A, C sub clause (b), it will he highly improper and premature for this Court to hold that there was no reasonable ground for believing him to be not guilty and with these observations dismissed the bail application and sent him to Jail. According to case the Drug Inspector Jammu Zone lodged a complaint against Madan Lal Aggarwal for offence u/s 18-A, 28 (VI) r/w section 27-D of Drug & Cosmetic Act and Rules 106 and pursuance to the process so directed, accused has appeared before this Court. As per the direction of the Court Madan Lal Aggarwal appeared in the Court today and filed bail application which was opposed by the Additional Public Prosecutor GS Charak appeared for the State. During the Course of Arguments APP submitted that offence committed by the accused effect society at large for the reason that he has failed to disclosed that wherefrom he has purchased the drugs which were found stocked in the premises of Vishwa Swasth Dham having not disclosed this fact. It can be safely presumed that he had purchased the said drugs from an unauthorized dealer.
