J&K prefers not to penalize mantris, babus; SAC recommendations pending

JAMMU, Dec 15: Chief Minister Omar Abdullah's government has unique distinction of penalizing lower ranking officers while allowing blue-eyed, politically suitable, corrupt but so-called efficient officers to retire mutely.
Repeated pronouncements of government initiating probe into the assets of several KAS, IAS, IPS officers alongwith two particular National Conference (NC) ministers of ruling coalition seem to be mere witch hunting and can be brutally described as 'remote control to silent dissent and a way to ensure officers remain loyal to the regime." Officers and ministers, against whom cases are pending in various courts, have been rewarded with choice postings and ministries instead of being penalized.
Ask for the reasons and the government would tell you "No case has been proved against these officials. You are not guilty until proven so." This reasoning results in "cases not being proved against the officers and judgments pronounced either in their favour or against them, years after their retirement from the government service." Jammu and Kashmir government has the worst record of penalizing Babus and Mantris.
State Accountability Commission (SAC) probed several complaints and even send detailed recommendatory notes to the government for taking against delinquent officers and ministers. Most of these cases are sub-judice and pending in various courts across the state. Among these cases are the ones against ex-Director Social Welfare Ghulam Nabi Boda (Retired), Sheikh Fayaz the then Deputy Director Estates and presently, Joint Transport Commissioner (JTC), G.N.Qasba, Registrar Cooperative Jammu and presently, Director SKICC and Rajinder Tickoo (retired), the then Commissioner Transport.
SAC had also made recommendations in the cases against Ex-Chairman State Forest Corporation (SFC), officials of State Vigilance Organization (SVO), Khursheed Naqeeb (Retired) Commissioner/Secretary to Government, Mohammed Deen, ex-Commissioner/Secretary Animal and Sheep Husbandry, the then Deputy Commissioner (DC) Udhampur Atal Dulloo, the then General Manager SFC North Abdul Rashid Keema and others, Ravinder Gupta, ex-Secretary Jammu and Kashmir State Sports Council, MAM stadium, Jammu and several other officials.
Ironically, even if the cases are proven false at a later date against the officials mentioned above in the court of law, bitterness of someone especially commoner having complained against them can be seen in the reply of these officials. "You write whatever you want to in this sub-judice matter. But what can you write in a case which is pending before court of law," said Commissioner/Secretary Tourism Atal Dullo.
Despite being known for his uprightness and integrity, SAC had recommended action against Dullo in a case pertaining to his tenure as Deputy Commissioner (DC) Udhampur. Same is stayed in court of law. Another IAS officer alongwith three officials of revenue department have also been arrayed as accused in this case. SAC had recommended for dismissal of these three revenue officials under rule 30 of J&K CCA rules 1956.
Another official when asked about case against him said "You are digging out things buried years ago. Let the court decide. We are no one to adjudicate in issues pending before the court of law." When asked specifically about the case, the official said "It was a complaint filed by a person due to personal enmity. Court will acquit me. SAC tarnished my image and damaged my credibility."
