| HC quashes detention of HM activist | | | EARLY TIMES REPORT
Jammu, December-17 (JNF):- Justice Hasnain Massodi today quashed the detention order of District Magistrate Kishtwar whereby DM directed detention of one Irshan Ahmed s/o Ghulam Mustafa Akhoon r/o Village Lidri Dachin Tehsil Marwah District Kishtwar.
According to the detention order that detenue is alleged to be Over Ground Worker of Hizbul Mujahdeen Outfit and was detained under PSA. In the ground of detention and detention order makes mention of cases FIR No 242/2010 u/s 363/120-B RPC, 13/18 ULA Act P/S Kishtwar registered against the detenue. The involvement of the detenue in aforementioned case appears too heavy weighed with detaining authority while making detention order.
The Court after hearing both the sides observed that the the petition is allowed and detention order passed by the District Magistrate Kishtwar directed detention of Irshad Ahmed is quashed and directed the authorities to release the detenue from preventive detention. JNF
