PSC Asstt surgeons selection list comes under scanner, aspirants seek SVO probe

jammu, Dec 19: Jammu and Kashmir Public Service Commission's selection list of the Assistant Surgeons in the Health and Medical Education Department has come under clouds with certain insiders alleging 'foul play.'
It has been alleged that commission modified rules to adjust and accommodate blue eyed candidates. In a written complaint to the State Vigilance Organization (SVO), it has been alleged that interview decimated hopes of those who were almost sure of their selection after having done exceedingly well in the screening test were dumbstruck when they found themselves out of the selection list.
The complaint maintains that a case has already been filed in the High Court against the alleged manipulations in the selection list. The complainants have alleged that merit list includes the names of candidates possessing percentages in eighties while as certain candidates having more than 90 percent marks have been ignored. They have said that nepotism reflects clearly from the merit list.
Citing the instances, complainants have alleged that notifications were issued and then withdrawn, clearly with intent to favour certain blue-eyed candidates. PSC first issued a notification No: 03-PSC of 2011 on March 22, 2011 specifying certain criteria for selection of Assistant Surgeons against existing vacancies in ratio of 1:3 ratio. Through this notification, candidates were called for screening test.
However, PSC for reasons better known to it issued another notification vide no: PSC/EX/11/44 Dated March 30, 2011 notifying amendment of Rule 51of J&K Public Service Commission (Business and Procedure) Rules, 1980. Through this notification, criterion for selection was revised. PSC stated that it would treat candidates doing MD as having held the post for the period during which they were pursuing MD.
Through this notification, insiders in PSC maintain that around 7 to 8 blue-eyed candidates became eligible for post of Assistant Surgeon. They assert that viva ensured selection of these blue-eyed candidates as Assistant Surgeons and rejection of deserving meritorious candidates. "Deserving and meritorious candidates of all the three regions .e. Jammu, Kashmir as well as Ladakh have been denied their rightful due. SVO should immediately initiate preliminary inquiry to ascertain facts. Once facts are ascertained, full-fledged inquiry should be initiated against PSC," complainants have demanded.
Insiders told Early Times that one of the members of the commission had resented the entire selection process and asked the commission to review its decision of changing the criteria within days of notifying it in the newspapers across the state. However, insiders disclosed that his pleas were not heard and list was issued. He had held out that commission has been using interview as tool to topple meritorious candidates.
Though complainants had approached commission seeking redressal of their grievances but they have said that none heard their plea. "We were turned out and told bluntly not to create unnecessary controversies. They advised us to knock at the door of court and we did the same," asserted one of the complainants. He said that when they approached the court, they got the appointment process stayed.
"It prima facie appears that the evaluation of merit of the competing candidates has not been made by the J&K Public Service Commission in accordance with the settled legal principles of law. Such a selection process prima facie appears to be in violation of the mandate contained in Art 14 of the Constitution of India," was the observation made by the Justice Muzaffar Hussain Attar of J&K High Court at its Srinagar wing while entertaining a writ petition titled Dr Mohammed Muzaffar regarding selection process adopted by PSC for the appointment of Assistant Surgeons.
