HC upheld the order of Removal of Lambardar | | | EARLY TIMES REPORT Jammu, Dec 21: responding to petition filed by one Onkar Singh Lambardar of Village Kaloen Tehsil R.S.Pura whose engagement was set-aside by the order of Financial Commissioner, the J&K High Court dismissed the petition and upheld the order of Financial Commissioner. Justice JP Singh of J&K High Court Jammu Wing after hearing Onkar Singh petitioner in person and Janak Singh respondent also in person and gone through the order in which the petitioner was appointed as Lambardar by Tehsildar RS Pura on September 1, 2006 and his engagement was confirmed by the Deputy Commissioner Jammu on September 5, 2006 and observed that petitioner was unable to read and write Urdu under the Rule 3 of the Jammu and Kashmir Lambardari Rules, 1980 indicates those factors that disqualify a person for election or appointment as Lambardar. Court having been found unable to read and write Urdu, the petitioner cannot invoke Extra Ordinary Writ Jurisdiction of the Court to perpetuate his, even otherwise, illegal appointment as Lambardar. With these observations Court dismissed the petition and upheld the order of Financial Commissioner. JNF
