Tenders for Baghliar I & II allotted without proper procedure
RTI petition brings JKPDC under scanner CVF Kishtwar demands probe into irregularities

kishtwar, Dec 23: The Power Development Corporation (PDC) alloted tenders for construction of Baghliar Iand Baghliar II having the capacity of 450 MW each to Jai Prakash Industries Limited without inviting national or global tenders as required by rules. This was stated by PDC Information Officer I A Kakroo in response to an RTI petition filed by Mashood Ahmad Matto who heads the Chenab Valley forum Kishtwar.
"The bid for construct of Baglihar Hydro Electrical Power Project (BHEP) stage I was awarded to Jai Prakash Industries Limited after the Board of the Directors JKSPDC in its 4th meeting held on 29-07-1997 had decided that Memorandum of Understanding (MoU) will be adopted for awarding of contracts to shortlisted agencies in case of BHEP- Stage-I vide Govt. order No: PDD/IV-21/85 III dated 09-04-1999 and accordingly the work was allotted in favour of Jai Prakash Industries Limited without issuing global tendering or even national tendering", Kakroo said.
Pertinently when the tender was allotted to Jai Prakesh Industries Limited without completion of legal formalities, Union Minister for New and Renewable Resources Dr Farooq Abdullah was at the helm of the affairs in Jammu Kashmir while Surjeet Singh Salaithia, presently Industries and Commerce Minister was the minister for power.
Justifyinmg allotment of Baghliar II works to the Jai Prakash Industries Limited, Kakroo said: "The construction work of BHEP-II has also been awarded to Jai Prakash Industries Limited without issuing any tender at National or global level since BHEP-Stage-II is an extension of BHEP-Stage-I with common dam and intake works, as a result of which the government founds feasible to allot the contract to the same agency which was executing BHEP-Stage-I to avoid over lapping of Works, interference scheduled problems with consequent slippage of time lines. On the bases of the above mentioned reasons, the State Govt. vide its order No: 193-PDD of 2002 dated 28-=6-2002 approved allotment of Civil and Hydro Mechanical works of BHEP State-II to JP Associates on the similar terms and conditions as was applied for BHEP Stage-I."
It was not only the government issued the tender for construction of first state owned power project I.e. BHEP Stage-I without following the proper procedure, but also revised the cost of the construction of the project from 3495 corers in 1999 to 4000 corers in 2004, where as the project was completed in October 2008 and the same rose to over Rs. 5000 Corers and stands at 5827 Corers as adopted by the Board of Directors JKSPDC in its 58th meeting held on 15-10-2009.
As per the details provided by the JKSPDC, the government of Jammu Kashmir has so far paid Rs. 3824.271 Corers to M/S Jai Prakesh Associates Limited ending October 2011 which includes the payments on account of some essential/common/critical works of BHEP stage-II also. Moreover Rs. 705.409 Corers were also paid to Voyath Siemens and Rs. 145.75 Corers were paid to M/S Lahmeyer International Gmbh (EIC) ending October 2011.
As per the details, Chief Minister Omar Abdullah who himself holds the charge of power ministry sanctioned the estimated cost for construction of Stage-II of BHEP at Rs. 3420 Corers in April 2010 after JKSPDC submitted the DPR of the project.
The cost of the BHEP Stage-II has been fixed on the price level of December 2009 with completion period of 50 months from the date of order to commencement. The Chairman CVF Kishtwar Mashood Ahmed Mattoo said that as per the reply given by the JKSPDC, all norms were thrown to winds while making the allotment of BHEP Stage-I and II. he said the that the reply given by JKSPDC vide letter No: JKSPDC/ADM/EG-98/3087 is enough to initiate the probe against the issuing authorities. He said that issuance of tender in favour of Jai Prakesh Industries Limited is similar to the case of 2G scam where the contracts were allotted to various companies without fulfilling the legal formalities and demanded stern action against all those people who are involved in allotting the tender as a result of which the state government suffers the huge losses, while a private company earns corers of rupees through illegal process of availing tender bid for construction of 900 MW BHEP Stage-I and II.
It is worth mentioning that JKSPDC (Corporation) was incorporated as "Jammu and Kashmir State Power Development Corporation Private Limited" on 16th of February 1995 under the Companies Act, 1956. Subsequently, the Corporation was converted to public limited Company and the name was changed to "Jammu and Kashmir State Power Development Corporation Limited" and a new Certificate of Incorporation was issued by the Registrar of Companies, Jammu & Kashmir, at Jammu on 24th November, 1999. The Corporation is fully owned by the State Government of Jammu & Kashmir.
