Norms twisting: 26 kanals of government land in Sidhra allotted on 'non-existing orders'

Jammu, Dec 29: Some works are done by flexing the set norms and it is evident from a official reply from Public Information Officer (PIO) to a RTI application that government land valuing crores has been allotted to some influential persons in Sidhra on non existing order. These revelations came in forefront in response to an RTI application filed by Advocate Vilakshan Singh who stated that RTI reply about land allotment of government land is stated to be another jolt to credibility of revenue officials especially when the registration of documents to the revenue has already raised eye brows of common people.
The filed application through RTI after he came to know that 26 kanal of government land in Sidhra has been illegally grabbed by certain persons. The response he got through PIO Jammu against his application was quite shocking. In a two line response PIO Jammu vide her letter no. DCJ/PIO/RTI/11-12/87 dated 19.05.2011 said: The allotment of 26 kanals of prime government land in Sidhra did not exist in revenue record at all.
The land was allotted to some person by then tehsildar Samba, according to his sweet will as when the allotment was done Sidhra was in Samba tehsil, the reply stated. RTI activist said that earlier, PIO was reluctant to provide information within the statutory time limits and it was after DC Jammu's intervention, who happens to be the 1st Appellate Authority, directed PIO to provide proper information to the information seeker.
As per information provided by PIO 26 kanals of land comprising Khasra no.65, 72 & 74 at village Sidhra has been allotted to one Khayali Ram son of Prabh Dayal. vide order of Custodian Evacuee Property with powers of PRO no. 212-13/86 dated 12/03/1986 and order dated 11.12. 2006 of Tehsildar Samba. But the said PIO did not provide the copy of the said allotment order on the pretext that it was not available in the revenue records. The information provided by the PIO revealed that above said land was mutated in the name of Khayali Ram son of Prabh Dayal on 11.12.2006. But surprisingly the said land was mutated in the name Khayali Ram's sons on 25/08/2006 ( i.e about four months prior to mutation in favour of Khayali Ram himself) on the ground that Khayali Ram had expired. The said information provided by the PIO further fortified the doubt regarding the illegality in the said transaction.
RTI activist said that aggrieved by the non-disclosure of copy of the allotment order, RTI activist filed complaint u/s 15 of J&K RTI Act before the J&K State Information Commission which directed the said PIO/ADC to provide a copy of the said allotment order to the complainant within 2 week's time after seeking the copy of the said order from the Custodian Department. Meanwhile Custodian (Ex officio Provincial Rehabilitation Officer) Jammu in his letter no. PRO/2011-12/584-85 dated 03/12/2011 categorically stated, "I am to intimate that the allotment file of the said land is not forth coming from the record. Moreover the above said no. i.e 212-13/86 dated 12.03.86 is not existing in dispatch register bearing no. and date mentioned above as reported by the dealing assistant." The above said letter of Custodian Jammu makes it ample clear that allotment of above said land has never been made by the said department and the said fake allotment has been made on the basis of order that never existed.
