| Consumer Forum penalizes VC, Secretary JDA for harassing aspirant | | | EARLY TIMES REPORT
Jammu Dec 30Court of Divisional Consumer Forum Jammu has penalized the Vice Chairman and Secretary, Jammu Development Authority for ignoring Forum’s verdict given earlier and harassing applicant on various pretexts.
According to verdict the following re- complaint forwarded by one Ashok Kumar son of Late Pitamber Nath resident of Killi Mandi,Samba( decree holder) before the Consumer Forum, the Consumer Forum in its latest judgment directed JDA officials to pay Rs 7000 to the Decree Holder within one month positively with interest at the rate of 8% per annum from the date of order dated 16.05.2007 till the entire amount is paid.
The JDA officials are further directed to pay an amount at the rate of Rs 500 per day counting from 21-05-201 (date of executing the lease deed by the decree holder) in the first instance and Rs 100 per day thereafter till the entire amount is disbursed in favor of the Decree Holder on account of forced litigation even for receipt of compensation awarded by Divisional Forum with the warning of coercive action if the legal direction is not complied.
Earlier, the complainant filed complaint against JDA officials alleging that he was suppose to allot a plot in Digiana in 1995 but the venue of plot was shifted to Ploura after fifteen years of long gap. However, on a complaint being filed, the Divisional Forum passed an order dated 16.4.2007 directing the Judgment Debtors(JDA officials) herein to deliver the possession of plot in Digiana Housing Colony within five weeks from the date of order with, of course, compensation.
The Forum further directed that if the order is not complied with in stipulated period, the Judgment Debtors would pay a penal compensation of Rs 500 per day till the possession of the said plot is physically delivered to the Decree Holder. This allotment however, did not mature and the Forum passed another order dated 25.4.2009 with the direction to the Judgment Debtors to deliver the possession of plot as far as possible to the applicant. Despite the order passed by the Divisional Forum a lease deed came to be executed after formalities on 21.5.2010 and physical possession of the plot was delivered to the complainant on 29.12.2010. The Judgment Debtors however, did not pay the amount of compensation awarded by the Divisional Forum following which complainant re-filed his complaint alleging there in that Other Parties (JDA officials) which were bound by virtue of the order to pay an amount of Rs 5000 as compensation and Rs 2000 as litigation charges had not paid to him.
