Judicial Custody of High Court Blast Accused Extended | | | NEW DELHI, JAN 02: The judicial custody of suspected terrorists Wasim Akram Malik and Amir Abbas Dev, arrested for their alleged role in the September 7 blast outside the Delhi High Court premises, was today extended by a court here. District Judge H S Sharma extended the judicial custody of Dev till January 16 while that of Malik till January 17 after National Investigation Agency (NIA) said they want the accused to be produced in the court on separate days, court sources said.
Both the accused were produced in the court during an in-chamber hearing after the expiry of their judicial custody tenure.
According to court sources, NIA told the court that the probe into the blast, which killed 15 people and injured 70, was still going on.
The investigating agency has said Malik is a 'key link' in the conspiracy behind the blast outside gate number 5 of the High Court.
The court had earlier dismissed NIA's plea for Malik's polygraph test after he had expressed "unwillingness" to undergo the test.
Polygraph test is conducted to ascertain the truthfulness of a person's statements given in response to the probe agency's queries but according to a Supreme Court ruling, a person cannot be compelled to undergo such tests like brain mapping and narco analysis.
Dev, a native of Jammu and Kashmir, has been accused of sending terror e-mails to media groups after the blast.
A magistrate had earlier recorded Dev's testimony under Section 164 of the CrPC in an in-camera proceeding.
The statements recorded by a magistrate under section 164 of the CrPC bind the accused and any U-turn during the trial would make him liable for prosecution for the offence of perjury.
