DB directs Govt to provide ‘free education to disable children | | | Jammu, Jan 2: Responding to Public Interest Litigation (PIL) filed by National Federation of Blind J&K Branch seeking implementation of the order of Division Bench passed in LPA on March 30, 2009, Division Bench of J&K High Court Jammu Wing said children of the State suffering with the disability are entitled certain special privileges to be provided by way of free education and other facilities/amenities in the educational institutions.. Division Bench of J&k High Court Jammu Wing comprising Chief Justice FM Ibrahim Kalifulla and Justice Virender Singh after hearing Sr Adv PS Dutta for the PIL whereas Advocate General MI Qadiri for the state took serious note of the functionaries of the state observed that having notice such casual manner at which the state Govt has responded to the order March 30, 2009. Apparently realizing the seriousness at which this Court wanted to take action for compliance of the order March 30, 2009, the Advocate General representing the State give an assurance that the compliance of the order will be reported in every respect by first week of February, 2012. Reposing confidence in Advocate General and with a view to give a final opportunity to the respondent State, Division Bench directed that compliance of the directions dated March 30, 2009 should be reported with fail on February 6, 2012. Failing compliance the Chief Secretary himself should be present in Court to answer the queries of this Court. DB further directed that a separate shall be filed with regards to steps taken for comply with those statutory requirements and directed the Registry to list this PIL on February 6, 2012. (JNF)
