Jammu, Jan-5 : Principal Sessions Judge Jammu today awarded life-impriosnment to one Ajay Kumar of Dharamsal Tehsil Kalakote District Rajouri facing trial for the last 16 years for committing the murder of Bishamber Dass.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing both the sides observed that the case was pending in the court of Principal Sessions Judge, Rajouri but by the order of High Court the case was transferred to this court for disposal under law and further observed that At times one feels not to take a lenient view of the matter because it will not serve the ends of justice but the same time the awarding of death sentence is though within the ambit of jurisdiction of the court does not clothes the court to exercise the same in a manner indiscriminate.
Court awarded life-imprisonment to convict/accused Ajay Kumar a fine of Rs. 10,000/- (rupees ten thousand only) u/s 302 RPC.
In default of payment of fine, he shall further suffer an imprisonment for six months and accused/convict Ajay Kumar also shall suffer rigorous imprisonment for five years and a fine of Rs. 1,000/- (rupees one thousand only) u/s 392 RPC. In default of payment of fine, he shall further suffer an imprisonment for six months. However, both the sentences shall run concurrently.
According to the police case that a reliable source received an information that the deceased is admitted in the hospital in an injured condition and recorded his statement, who was beaten by accused mercilessly and the money about Rs. 305/- was also snatched. (JNF)
