Court awards 10 years 'rigorous imprisonment' to rapist | | | EARLY TIMERS REPORT Jammu, Jan 10: 3rd Additional Sessions Judge Jammu today awarded 10 years rigorous imprisonment and fine Rs 15000/- to accused Rinku Kumar of Akhnoor for kidnapping and raped minor girl. 3rd Additional Sessions Judge Jammu Sanjay Parihar after hearing APP GS Charak for the state whereas Adv Vijay Gupta for the accused observed that accused has been convicted for act of having first kidnapped prosecutrix, he committed rape on her against her consent in his native village. With these observations Court awarded seven years RI and fine Rs 10,000 u/s 376 RPC and 3 years RI and fine Rs 5000 u/s 363 RPC. Court further clarified that both the sentences shall run concurrently. According to the prosecution case that on June 23, 2003 that prosecutrix who had been to Jammu City for tuition did not returned home thereby her father started search when she did not report back, the father of the girl lodged missing report at Police Post Digiana on that very day. On June 25, 2003, the father of the prosecutrix came to know that accused Rinku had kidnapped her daughter aged 12 years and the other have facilitated in taking away of prosecutrix by the said person with intent to be sexually exploited by him to his native village Neramandrian. The father of victim lodged FIR against accused which was registered u/s 363/368 and started investigation. The further case of the prosecution is that on June 27, 2003 victim was recovered and was got medically examined and a case u/s 342/363/376 and 368 RPC was registered. (JNF) |
