Wrongful confinement case

Jammu, Jan 10: Special Municipal Mobile Magistrate Jammu has directed SSP Jammu to register FIR against Tejinder Singh then SHO P/S Gharota and investigate the matter under law and further ordered that matter shall be shared with this Court on or before January 28.
Special Municipal Mobile Magistrate Jammu V S Bhou today directed SSP Jammu to register FIR against Tejinder Singh then SHO P/S Gharota and investigate the matter under law. This direction was issued against a complaint filed by Mohd Shafi and Shamsher Chand owner and driver of truck against then SHO Gharota, the complaint was filed through Adv Shah Mohd Choudhary in which it has been submitted that on November 23, 2011, one Lain Din r/o Kanger hired the truck of the complainant for carrying of firewood from his land situated at village Kanger.
When the truck was half loaded, in the meantime the labourer stooped loading as it was already 5:00 PM. The half loaded vehicle was left on spot and driver of the vehicle remained inside the vehicle with a hope to start loading on next day morning. Meanwhile during the intervening night November 23/24, the Gharota Police Station raided the vehicle and was taken to police station.
The driver was also taken to police station.
On November 24 when the owner of the vehicle approached the police to enquire about the driver and vehicle, the complainant was also illegally detained by then SHO. It was further submitted that vehicle of the complainant was also seized by then SHO and subsequently handed over to DFO Jammu. According to complainant DFO Jammu vide its order December 14, 2011 released the vehicle in favour of the complainant and confiscation proceedings were dropped.
In the complaint it is further submitted that Munshi of the Police Station Gharota Mohd Yousaf had taken away Rs 7800/- from the vehicle and also Rs 5000/- during the personal search of the complainant and seeking action against then SHO P/S Gahrota the complainant filed the complaint u/s 156 (3) CrPC.
