| HC stays transfer of Executive Officer Municipal Committee | | |

Jammu, Jan 12: Vacation Judge of J&K High Court Jammu Wing responding to a petition filed by Abdul Kabir Malik Incharge Executive Officer Municipal Committee Thanamandi who was transferred allegedly at the behest of minister concerned, today ordered that petitioner will be allowed to continue as Incharge Executive Officer Municipal Committee Thanamandi.
Vacation Judge of J&K High Court Jammu Wing Justice Muzaffar Hussain Attar observed that in terms of order dated November 26, 2011, petitioner was transferred and directed to look-after the work of Incharge Executive Officer Municipal Committee Thanamandi, private respondent Manzoor Ahmed Lone presently posted as I/C Executive Officer Tehsil Kalakote Rajouri to be relieved of his additional charge of Incharge Executive Officer Municipal Committee Thanamandi.
Complying with the said order petitioner joined on November 28, 2011 as Incharge Executive Officer Municipal Committee Thanamandi and private respondent was also relieved from the Municipal Committee Thanamandi. In terms of order impugned December 1, 2011 passed by passed by Director Urban Local Bodies Jammu the order of transfer of petitioner issued on November 26, 2011 was withdrawn. Court further observed that the Director Urban Local Bodies Jammu after ordering transfer of petitioner vide order dated November 26, 2011 has withdrawn the said order in terms of order impugned and it appears that the same has been done in pursuance to the directions issued by Concerned Minister. "An employee of the state Govt cannot be transferred from one place to another place in the manner the same has been done in this case, court said.
Court further said that till the decision is taken order impugned December 1, 2011 passed by Director Local Bodies Jammu shall not be acted upon and petitioner will be allowed to continue as Incharge Executive Officer Municipal Committee Thanamandi. (JNF) |
