Court grants conditional interim bail to alleged accused except Ashwani

Jammu, Jan 14: 2nd Additional Sessions Judge Jammu today granted interim conditional bail to all the alleged accused except accused Ashwani Kumar against whom General Arrest Warrants 512 CrPC involved in much publicized Durga Nagar Sex Scam.
2nd Additional Sessions Judge Jammu Subash C Gupta after hearing both the sides while granting interim conditional bail to all the accused observed that Court is of the considered opinion that accused/petitioners are entitled to be released on interim conditional bail at this stage, till next date and directed accused be released from custody if they furnish surety and personal bond to the tune of Rs 50,000 each and imposed the conditions that passport shall be deposited with the Court, they shall not leave the jurisdiction of this Court without its prior permission and they shall not temper prosecution witnesses or hamper the further trial of the case in any manner. "In case any of the accused violates any of the condition, prosecution is at liberty to move this Court for get cancellation of the bail of the defaulters, court said.
According to the police case that on May 26, 2011, the prosecutrix lodged a written report to P/S Domana to the effect that the complainant is15/16 years and resident of village of Kishtwar and her parents have expired. She is also having no brother and sister. One Santosh Devi resident of her Village and has married at Durga Nagar Jammu. On the day of Shivratri Santosh Devi visited her house at Kishtwar and told her that she will solemnize her marriage with a handsome boy in Jammu. By enticing the complainant for getting her married by fully knowing that the complainant is a helpless girl brought her to Jammu at Durga Nagar and was forced to illicit inter-course with persons without her consent and now ultimately she has escaped from the clutches of Santosh Devi. On recipet of report a case has been registered under FIR NO 170/2011 u/s 366-A/376 RPC.
The accused namely Ashish Abrol, Pradeep Loria, Jasvinder Singh @Titu, Pawan Kumar, Raman Gupta, Deepak Gupta, Surjeet Singh Singh @ Sonu, Santosh Devi w/o Krishan Lal r/o Kishtwar at present House NO 18 Durga Nagar Jammu, Saroja Devi w/o Hari Krishan r/o Saya Kishtwar, Nitish Sharma and Kanav Suri have filed applications seeking bail.
It is clarified that accused-petitioners namely Deepak Gupta, Pawan Kumar and Pardeep Loria have filed joint application seeking bail in their favour being accused in case titled State Vs Ashwani Kumar under FIR No 170/2011 u/s 376/366-A/109 RPC. In the main challan charges have already been framed against accused persons.
