Commission serves notice to Talib, other witnesses still not contacted
Sayed Yusuf custodial death case

Jammu, Jan 19: Justice (Retd) H S Bedi commission in its first attempt to record the statements of the concerned, has served a notice to the son of Sayed Yusuf who died in mysterious circumstances under police custody on September 29, last year after he was handed over to Crime Branch at Chief Minister's residence.
Sources said that Talib Hussain son of the deceased was served notice by the commission probing the alleged custodial death of his father and NC worker Sayed Yusuf, however, two other key witnesses in the case Ab. Salam Reshi and Muhammad Yusuf Bhat have not been contacted by the commission as yet.
Confirming that he has received notice from the commission Talib said that he was in process of consulting legal expert to file reply to the notice. " I am in touch with my lawyer to prepare a detailed factual reply to the notice" Talib said.
When asked whether he would appear before the commission, Talib said that there was no harm in appearing in person before the commission. " For want of Justice I would like to meet the commission in person also and put my view point before the commission, in fact I visited Commission's office a couple of days ago but there was only clerical staff present in the office" Talib said.
He said that he will leave no stone unturned to prove my father's innocence and would like to seek answer from the concerned quarters whether through the court or the commission. Meanwhile the key witness in Hai Yusuf custodial death case, Ab. Salam Reshi Friday and Muhammad Yusuf Bhat have not been informed by the commission as yet. When contacted Ab. Salam Reshi said that he has not received any communication from the commission as yet" When asked what would be his future cource of action for being key witness in the alleged custodial death, Reshi said Justice (Rtd) H S Bedi Commission has no evidence on the basis of which, the commission can give any verdict.
Reshi, who was present at chief Minister Omar Abdullah's private residence in Srinagar when the political fixer cum National Conference worker Sayed Yusuf was summoned by minister of state for Home, Nasir Aslam Wani on the instructions of Chief Minister to his residence on September 29, 2010, termed the Bedi Commission as eyewash saying that even the terms of reference of the commission were not made public " I am convinced that the evidences have been destroyed and there was no fun to depose before the commission" Salam Reshi said. The second most important eyewitness of Sayed Yusuf custodial death case Muhammad Yusuf Bhat too has not received any notice from the commission, however, sources said Bhat was in constant touch with some senior National Conference leaders and as such his chances of appearing before the commission were bleak. Pertinently Bhat arrived in Jammy on January 12, a day after Justice Bedi reached Srinagar is reportedly in Jammu. Sources said Bhat had several rounds of meetings with senior NC leaders during past several days.
It merits a mention here that soon after the arrival of Justice Bedi on January 11, Secretary of the Commission, Additional District Judge anti-corruption Jammu, Jaffar Hussain Baigh issued a public notice asking the people and groups who want or who are acquainted with the case to depose in the form of affidavits.
"The Commission of Inquiry issues this notice inviting all individuals, groups of persons, associations, institutions and organizations having knowledge directly or indirectly of facts and circumstances relating to the matter referred to the Commission, and having interest in the proceedings before the Commission, or are otherwise acquainted with the matter to furnish to the Commission statement(s) relating to the above terms of reference. Such statement(s) should be in form of an affidavit(s) in respect of the facts set out in the statement(s)," reads the notice issued by the Commission.
