Court awarded imprisonment, fine to then CAO Kupwara

Jammu, Jan 20: Special Judge Anticorruption Jammu today awarded one year imprisonment and fine Rs 10,000 to 71 years old Abdul Qayoom Bhat then Chief Agriculture Officer Kupwara after 13 years investigation and Trial in the case in which the accused made appointments without any authority.
Special Judge Anticorruption Pawan Dev Kotwal after hearing CPO Parshtom Sharma appearing for the VOJ whereas Adv Ajay Kotwal appeared for the accused and accused was present in person and observed that prosecution has succeeded in establishing beyond every shadow of doubt that accused at the relevant time having been posted as Chief Agriculture Officer Kupwara was not competent to make appointment of even class IV employees, but he appointed on temporary adhoc basis despite ban imposed by the Govt for such appointments and subsequently regularized the services temporary/adhoc appointees under the grab of Court directions.
"Though there were no such directions from the Court and he with dishonest intention to confer pecuniary advantage on the appointees, by abuse of his official position and in this regard to established procedure for appointments, adhoc as well as regular, issued orders of regularization in the favour of appointees. Charge of criminal misconduct as envisaged in section 5(1) (d) and punishable u/s 5(2) J&K PC Act SVT 2006 is established against the accused beyond all reasonable doubt and therefore he is held guilty of the said offences and awarded one year imprisonment and fine Rs 10,000/-, court added.
The accused was directed to be taken into custody of CPO and sent to District Jail Jammu to serve the sentence imposed upon him.
According to case during the investigation Investigating Officer appears to have seized relevant record and recorded the statement of witnesses u/s 161 CrPC and concluded that accused was Chief Agriculture Officer Kupwara in the year 1996-1997 and by abusing his official position he engaged the candidates on adhoc basis for 89 days and thereafter regularized their services under the grab of Court directions.
