| HC issues notices to comm/secy hr edu, director colleges | | | EARLY TIMES REPORT
JAMMU, Jan 22: The High Court of J&K at Jammu issued Notices to the Commissioner/Secretary Higher Education and Director Colleges in connection with writ petition No. 55 of 2012 filed by Prof S. K. Bhalla, Ex-Principal GDC Mendhar. The High Court under Article 226 of Constitution of India quashed Govt. Order No. 360 - HE of 2011 dated 17-10-2011 to extent the period of petitioner's illegal suspension w.e.f 8-10-2010 to 31-5-2011 was treated as on leave whatever kind due to the petitioner. The petitioner has requested the High Court to command the respondents to treat the petitioner's period of suspension as on duty as the petitioner had been placed under suspension without any lawful justification and the respondents miserably failed to conclude/conduct any inquiry till his superannuation on 31-5-2011.
After hearing Advocate S S Ahmed for the petitioner, the Justice Hussnain Masoodi directed for issuing the Notice to both the respondents reading at No. 4 "You will have to show cause as to why the petition may not be admitted to hearing". Permission was also granted for the Dasti servicing of the Notices issued Vide Nos. 808 and 809 dated 19-01-2012. The petitioner got the Notices serviced on the same date as the Court has sought the presence of the respondents on January 31, 2012. Copy of the Writ petition has already been received by the Office of Advocate General Vide No. 81 dated January 11, 2012. |
