CJM denies bail to close associate of Sunny Baba

Jammu, Jan 23: Chief Judicial Magistrate (CJM) Jammu today rejected bail application two close associate of a close of associate of Sunny Choudhary @ Sunny Baba who allegedly are involved in attack on prosecution witness in the Court complex. While rejecting bail application CJM Jammu Jatinder Singh Jamwal rejected bail application of the accused after hearing CPO Harminder Singh for the state. Court observed that allegations against accused appears to be well founded and are of serious nature of the allegations projected in the case of the prosecution can hardly be over emphasized, without going into details it specific to notice that the allegations against the applicants/accused are that on January 18, 2012 they along with accused namely Sunny Choudhary @ Sunny Baba assaulted the witness who was about to deposes against Sunny Choud hary and threatened him of dire consequences if he deposed against Sunny Choudhary in the said case and in another case in a different Court. The occurrence took place in Court premises and that too in full public view. Adverting to the plea of the counsel for the accused that the applicants had only came to meet an under trial who was to be produced in the court of law on the day of occurrence and they had nothing to do with the purported leading to registration of present case against them. CJM Jammu further observed that it is not possible to accept this plea of the counsel for the accused at this stage on the basis of material available. Court have no hesitation in observing that same is blatant attempt to under mind the prestige and dignity of the institution of the judiciary as also thwart the process of justice. The accused in the case do not deserve concession of bail and that too when the investigation is at initial stage. With these observations Court dismissed the bail application filed by the applicant-accused. JNF
