HC grants bail in cheating case

Jammu, Jan 27: Vacation Judge Justice JP Singh has granted bail to Balbir Singh s/o Rachpal Singh, Krishan Singh s/o Balbir Singh, and Sanjay Manhas s/o Balbir Singh, All R/o Ghou Manhasan tehsil Jammu who are allegedly involved in obtaining Loan from the ADB State Bank of India on fake and fictitious documents.
According to the Crime Branch Case that a written complaint lodged by Sh. Kuldeep Singh and Raghubir Singh sons of Suraj Karan Singh R/op Ghoumanhasan was received in Crime Branch, Jammu alleging therein that one Balbir Singh s/o Rashpal Singh andhis sons Krishan Singh and Sanjay Singh had obtained a loan amounting to Rs.3,00,000/- in the name of Sanjay Singh from ADB State Bank of India, Canal road, Jammu by executing a mortgage deed prepared on the basis of fake/fictitous jamabandi for the year 1957-58 and Shajra-aks pertaining to land measuring 10 kanals falling in khasra No.1249 situated at village Ghoumanhasan, tehsil Jammu. The land under khasra No.1249 measuring 60 kanals is execlusively in possession of complainants. One more mortgage deed was also executed by said Balbir Singh and his sons by illegally preparing /fabricating fard Intikhab, Jamabandi and site plan for the year 1957-58 pertaining to land measuring 10 kanals falling in khasra No.1248 situated in the same village.
On receipt of this complaint, an enquiry was initiated by Crime Branch, Jammu and during the course of enquiry, it was found that the accused persons had raised a loan from ADB State Bank of India, Canal Road, Jammu by executing a mortgage deed on the basis of fake/fictitious documents of land which was not in their possession and subsequently they did not liquidate the loan also. During the course of enquiry, prima facie, offences u/s 420,465,468,471 RPC have been made out against the accused persons. Accordingly, a formal case has been registered in P/S Crime Branch, Jammu against the accused persons on 19.12.11 and investigation of the case is entrusted to SI Farooq Ahmed, but he has not conducted the investigation. But later on the investigation has been entrusted the present I.O, who during the course of investigation seized the enquiry file produced by MHC P/S Crime Branch, Jammu and the investigation is at a very initial stage and in order to proceed further, the arrest of the accused persons is required besides completing other legal formalities.
The court after hearing the parties ordered that in the event of petitioner's arrest in case registered against them by the Crime Branch Jammu u/s 420/465/471 RPC, they shall be released on bail on furnishing personal and surety bond in the amount of Rs 10,000 each and they shall appear before the Investigating officer as and when so required.
