HC suspends sentence, grants bail to NR official

Jammu, Jan 27: Vacation Judge Justice JP Singh today suspended the sentence imposed by the Special Judge Anticorruption (CBI Cases J&K Jammu) and accordingly admitted bail on his furnishing personal and surety bond to the tune of Rs 20,000 to the satisfaction of the Special Judge. Court further ordered that the release of appellant shall, however be subject to deposit of fine Rs 10,000 with the Special Judge.
This order has been issued in a criminal appeal filed by through Advocate BS Slathia on various grounds. Court admitted the criminal appeal to hearing and issued notice to the respondents. Advocate JA Hamal accepted notice for CBI Jammu and keeping in view the issues that appellants counsel raises challenging the applicant's conviction and sentence on various facts. It is considered appropriate to suspend the appellant's sentence imposed by the Trial Court. Court suspends the sentence and granted bail to the convict.
According to the CBI case that on April 1, 2005 one Gurvinder Singh filed a written complaint with CBI Jammu with the allegations that the accused Ashok Kumar Sanyal, Assistant Divisional Engineer Northern Railway Jammu, had refused to clear his running bills unless the complainant paid a bribe of Rs. 20,000/- as a commission for an old bill cleared and approved by the accused earlier. This led to registration of case under FIR for offence under section 161 RPC and 5(2) read with 5(1) (d) of J&K PC Act 2006 after verification of complaint by Inspector P. S.Jamwal. The investigation was entrusted to Dy.SP Permodh Mudbatkal. A trap team was constituted by the CBI and laid trap and caught red-handed while accepting bribe amount. After completion of the investigation CBI presented challan against the accused. Special Judge Anticorruption CBI Cases on January 24, 2012 awarded one year's rigorous imprisonment and fine of Rs. 10,000/-. JNF
