Existing laws pertaining to Hindu married women to be amended | | | Early Times Report JAMMU, Jan 28 : In a meeting of AJKMPJ held at Jammu, a very important issue pertaining to Hindu married women who are victims of domestic violence and do not get proper justice because of unjust laws was discussed and finally it was decided that all MLA's and MLC's be requested to put up the matter in the Legislative Assembly and Legislative council to amend the existing laws through a Bill. Such aggrieved women have only two remedies that the law offers, one is to get Divorce and the other is to have monthly maintenance allowance from the husband. In the first case, it takes much long time to get at the final decision and for the destitute ladies, it is impossible to survive till then. In the second case there is a flaw in the law. The law in Jammu and Kashmir allows only a maximum amount of Rs. two thousand (Rs.2,000/-) per head (wife and children) irrespective of the pay or known sources of income of the husband. Even if his income is Rs. 50,000/- or Rs.1,00,000/- or more, wife and children get only a maximum of Rs. 2,000/- per head per month. This is not so in any other part of the country. There the rate of monthly maintenance is determined on merit with proper proportion. So in the name of justice, the law, as it prevails in J&K may kindly immediately be amended so as to ameliorate the sufferings of such destitute ladies. The meeting was attended by S. Deep Singh, Kuldeep Kumar Rao, Dr. G.S.Charak , Pankaj Sangral, S Gurtaj Singh, S N Saproo, R L Raina, Pardeep Kumar Bhagat , Kalyan Singh Chib, Y R Sharma, Rashem Singh, Bhari Lal Bhagat , Madan Gopal and others. |
