| Court frames charges against GPF employees | | | Jammu| Jan 16 Special Judge Anticorruption Jammu Mr. JR Kotwal today framed charges against accused Dinesh Sharma and Bodh Raj, the then Compilers in GP fund Office Udhampur while the former was caught red-handed by the Vigilance Organization team on April 3, 2006. Mr Kotwal after hearing CPO Mr. Onkar Singh appearing for the Vigilance Organization whereas Advocate Vinod Kotwal appearing for accused Bodh Raj and Advocate NP Kotwal appearing for accused Dinesh Sharma, said that upon consideration of the material on record in particular the statement of complainant, there appears a strong reason to believe that both the accused were involved in demanding and accepting the bribe from the complainant, even if it was only accused Dinesh Kumar who got trapped. Statement of complainant clearly shows that both the accused were present at the time of demand when it was initially made and it was accused Bodh Raj who had instructed the complainant to pay the bribe amount of Rs 2500/- to accused Dinesh Kumar and collect the papers from him. Conduct of the accused persons as per the statement of complainant clearly smacks of conspiracy between the accused persons. With these observations Court framed charges against both the accused U/Ss 5(2) r/w 5(1) (d) PC Act 2006 BK and 161, 120-B RPC and directed the prosecution to lead the evidence on the next date of hearing.. According to VO the complainant Pturan Chand who retired in March last had applied for release of his GP Fund for which the accused Bodh Raj demanded Rs 4000/- as illegal gratification from him for fraudulently making him known that the credit balance in his GP fund account shall be enhanced from Rs 8000/- to Rs 38000/-. Later on, the deal was settled at Rs 3000/- and on the same day accused accepted Rs 500/- from the complainant. In furtherance of the above conspiracy, on April 3, 2006, Vigilance team laid a trap and caught the accused red-handed while accepting Rs 2500/- as illegal gratification. |
