Court acquits husband and others from killing housewife

Jammu, Feb 1: Principal Sessions Judge Jammu today acquitted husband and his relatives who were facing trial for the last 13 years for allegedly killing of the wife of Babu Ram.
After hearing the case Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal acquitted Kartaro Devi wife of Beli Ram, Beli Ram son of Farangi Ram, Babu Ram, Baldev Raj sons of Beli Ram,Neeta Devi daughter of Beli Ram all Rathana (R S Pura) facing trial for allegedly killing of the wife of Babu Ram.
While acquitting the accused Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing Public Prosecutor Shabir Choudhary for the state whereas Adv Vishal Sharma for the accused persons observed that victim had almost 95% burns and she was put on oxygen right from the moment she was brought to the hospital and continued to be on oxygen till she died. The evidence on record shows that she died within about half an hour after making the alleged dying declaration. All these circumstances lead to one and the only conclusion that this dying declaration is not a genuine document and the High Court was justified in rejecting the same on that basis". With these observations Court is satisfied that the prosecution has failed to establish the case against the accused. Hence, the challan fails and the same is dismissed. Accused are acquitted of the charges.According to the police case that Police Post Government Medical College, Jammu informed the police further that a lady Bholi Devi has been admitted in the hospital on January 8, 1999 with 95% burn injuries. On January 7, 1999 at 11 AM she was in her in-laws house when she was sitting in her compound the accused dragged her inside the room. The police interceding the processual course of investigation recorded the statements of various prosecution witnesses presented report under sec.173 Cr.P.C. against the accused persons. ---(JNF)
