| CJM releases Rs 5 lakh seized by the police from JKBATM | | | Jammu|Jan 16 Chief Judicial Magistrate Jammu Mr. Sanjay Dhar on the application filed by Branch Manager of J&K Bank Kacchi Chowni released Rs 5, 51, 500/-, which were seized by the Pacca Danga police station in a complaint lodged by Anil Raina who withdrew Rs 7000/- from the said ATM and one of the currency note of Rs 500/- was found to be fake and on the complaint FIR was registered and the amount was seized. CJM, after hearing CPO Mr. Maroof Ahmed Manhas appearing for the police and Adv Subdoh Jamwal appearing for the J&K Bank, held that so far as the locus standi of the applicant is concerned, he is the branch manager of J&K Bank Kacchi Chowni Jammu.and the seized cash has been recovered from the ATM of the bank located at Kacchi Chowni Jammu. The applicant being the officer of the said bank is authorized to seek release of the cash. Coming to the stage of investigation, it is reported by the police that verification of cash was conducted by RBI Treasury and the Chief Manager of J&K Bank, Town Hall Jammu, the seized currency notes were found to be genuine whereas only one currency note which was produced by the complainant was fake. CPO has, however, submitted that investigating agency is taking further steps for verification of genuineness of seized currency notes and obtain certificate in this regard. CJM further observed that so far the seized cash is concerned, the same admittedly belongs to J&K Bank and prima-facie the seized cash is found to be genuine. If further verification of the seized currency notes is required and imposed condition for the release of the seized currency notes, these notes are not brought into circulation until its authenticity is further verified by the investigating agency. Accordingly the seized cash of Rs 5, 51, 500/- released in favour of J&K Bank through its Branch Manager. |
