After 14 yrs trial, Court convicted then SP Operation and other | PSI Ajay Gupta Killing case | | EARLY TIMES REPORT
Jammu, Feb 2: 2nd Additional Sessions Judge Jammu today convicted then SP Operation Surankote Sewak Singh and constable Satpal Singh @ TT convicted for committing the murder of PSI Ajay Gupta on October 13, 1998. 2nd Additional Sessions Judge Jammu Subash C Gupta after hearing Adv KL Sharma as Special Public Prosecutor for the state whereas Adv RK Kotwal for accused Sewak Singh and Sr Adv Sunil Sethi for accused Sat Pal Singh @ TT observed that on the night of 13th of October 1998, the deceased Ajay Gupta was killed by accused Satpal Singh with his SLR on the back side of his head while returning back in bullet proof Gypsy, having no. 8692/JK02E, after dropping contractor Abdul Khaliq at his residence, at Hardi Mohalla and reached TCP, Surankote, in furtherance of criminal conspiracy hatched between him and accused Sewak Singh. It can further be held with certainty that prosecution has succeeded in proving motive behind the commission of murder in the instant case and hatching of conspiracy qua accused Sewak Singh and accused Satpal Singh @ TT with these observations hold that prosecution has succeeded in proving commission of offence of murder infurtherance of hatched criminal conspiracy qua accused and destroying of evidence, punishable U/ss 302/120-B and 201 RPC against the accused namely Sewak Singh and Satpal Singh.. Accordingly, both the accused, namely Sewak Singh and Satpal Singh, are, hereby, convicted for commission of offences U/ss 302/120-B and 201 of RPC and fixed February 3, 2012 for the arguments on quantum. According to the police case that SHO, Police Station Surankote, namely S Jagjit Singh on 13th of October 1998 at 22.05 hours, registered a FIR having no. 172 of year 1998, for commission of offences under sections 302, 120-B, 121,122 RPC, 7/25, 26, 27 Arms Act and Section 3 EAO, on the basis of the written report lodged by S Sewak Singh, In-charge SP (OPS) Surankote, stating therein that PSI Ajay Gupta along with Mohd. Akram Driver, Constable Satpal Singh @ T.T, 597/P and Abdul Razak 554/P Bodyguards while returning from patrolling duty/ Naka were ambushed by ANES near TCP crossing. Thereafter the investigation of this case was transferred to Crime Branch Jammu and during investigation, it was revealed that S. Sewak Singh, SP(OPS) and PSI Ajay Gupta had a scuffle in the month of August 1998, at Surankote and in the said scuffle former slapped the latter. In the aforesaid occurrence, both the officers cocked their weapons and threatened to kill each other. However, accused Sewak Singh remarked at the relevant time that the time will show, who will kill whom”. According to the prosecution case that on 13th of October 1998, in the evening, there was a party in the house of accused Sewak Singh, C.O and 2/ IC of 27 RR, one Abdul Khaliq, a local contractor and PSI Ajay Gupta too participated in that party. CO, 2 IC and Abdul Khaliq left after sometime while contractor Abdul Khaliq requested S Sewak Singh to drop him at his residence. “Accused Sewak Singh asked PSI Ajay Gupta (deceased), Driver Mohd Akram, Constable Abdul Razaq and accused Constable Satpal Singh to drop Abdul Khaliq at his residence, case file said further adding accused Satpal Singh sat on the rear seat behind PSI Ajay Gupta. While passing near TCP crossing, a shot was heard inside the Gypsy and the driver of said Gypsy looked behind. The driver and the SPO Mohd Akram saw the SLR of Constable Satpal Singh in firing position aimed at PSI Ajay Gupta, who in the meanwhile fallen in the lap of the driver. Constable Satpal Singh jumped out and fired more shots in the air. However, he was over powered by Abdul Razaq and by the nearby Patrolling party of 83 Bn and his weapon was seized. Constable Abdul Razaq immediately reported matter to SP Operation that Satpal Singh @ TT killed Ajay Gupta, however he was asked by SP (Operation) to shut his mouth. Investigation further transpired that on the instructions of accused Sewak Singh, the blood stained clothes of the deceased Ajay Gupta were burnt and BP Gypsy No. 8692/ JKO2AE was washed. It is further on record of the investigation that a false FIR was registered and a false report was entered in Daily Diary of SOG. It has further revealed in the investigation that prior to incident, accused Sewak Singh asked the accused Satpal Singh in his bed room that the PSI Ajay Gupta should be eliminated showing a false encounter. |
