| Section 488 of CRPC should be amended | | | Early Times Report
JAMMU , Feb 2 : The members of All J&K Movement for Peace and Justice Kuldeep Kumar Rao and Dr. G.S Charak have appealed to Hon'ble Law and Parliamentary affairs Minister, Jenab Ali Mohammed Sagar and esteemed Law Secretary, J&K State government for putting up a bill in the assembly pertaining to amendment in Section 488 0f CRPC in the coming session commencing from Feb. 23rd 2012.
They said that in the centre as well as in all other States of the country, the maintenance allowance to be paid by the husband under section 488 of CRPC is determined as per income of the husband and as per status of the wife and children. But in J&K, the law imposes a limit of Rs.2000/= maximum per head per month irrespective of the income of the husband and irrespective of the fact that most of such women have no source of income. This is a great injustice to such women and their children and forces many such destitute ones to live in miserable poverty while the cruel and negligent husband enjoys luxuries. They also appeal to all MLA's & MLC's to support this bill in the coming session of the assembly commencing from February 23. This will be a great service to the cause of such sufferers. |
