Irregularities in KAS seniority Who shall seek an explanation from CM?

kishtwar, Feb 2: If Peerzada Muhammad Sayed has helped his foster son qualify the matriculation examination, the Chief Minister has promoted blue eyed KAS officers at the cost of deserving candidates. The Chief Minister ordered a Crime Branch probe into Peerzada's irregularity.
But who will proceed against the Chief Minister for tampering the KAS seniority list. The tentative seniority list of KAS Officers was issued vide order No: 485-GAD of 2010 dated 21-04-2010. However, around 30 blue eyed officers especially posted as private secretaries with Chief Minister Omar Abdullah and his cabinet colleagues were not happy with this order since there were no vacancies available for them in KAS carder.
These influential officers with the help of strong support from political lobby and persons in General Administrative Department (GAD) managed to tamper the list. Ironically, the affected officers were not even heard after the criterion for fixation of seniority was changed. The impugned seniority list was not even placed before the establishment committee that looks into KAS related promotions or before the state Cabinet for final nod. Instead vide order No: 1429-GAD of 2011 dated 14-12-2011, in which the KAS officers placed at the bottom of the seniority list were promoted to Additional Secretary and equivalent ranks.
While scrutinizing both the lists issued by the GAD, it was found that Asgar Hussain private secretary to Chief Minister Omar Abdullah, Hashmat Ali Private Secretary to Chief Secretary Madhav Lal, Dr. Ravi Shankar Sharma Private Secretary to Revenue Minister Raman Bhalla, Shakeel-ur-Rehman Private Secretary to Finance Minister Abdul Rahim Rather, Dr. GN Itoo Private Secretary to Social Welfare Minister Sakina Itoo, Kishore Singh Chib Private Secretary to Medical Education Minister, close relative to Union Minister for New and renewable resources (Nazim Zia Khan) were the major beneficiaries. The former Commissioner Secretary GAD M.S Khan also played a pivotal role and even managed operation of controversial seniority list in the garb of officiating arrangements on the plea that the government work was suffering. The height of manipulation is that all the Private Secretaries have got themselves designated as Official on Special Duty (OSD's) with the same ministers.
The arrangement, however, did not help the government in any way as the officers continued the job they had been doing. In some cases the officers have been transferred and posted against the posts which were already filled and thus making mockery off officiating arrangements and the urgency projected before the honorable court.
Some officers close to the former Commissioner Secretary GAD M S Khan and the political lobby are still occupying plum posts of higher grade and the government fails to stick to any fixed criteria in transparent manner.
An officer who remained for 12 years in the GAD and manipulated the list is again additional secretary home as no field posting is available for such officers in the government. In one such manipulation, when the seniority position of another KAS officer Farooq Shah, director Tourism Kashmir came to be challenged by an officer of Handloom Department and the seniority of the same officer despite court orders has not been taken into consideration. The court has initiated contempt proceedings against the government.
The case has been listed for hearing for 4-02-2012 in the High Court at Jammu. One Pardeep Kumar (KAS) who failed in the departmental examination and was entitled for induction only after January 2007 managed his induction illegally in the year 2006 and now has been allotted the vacancy of year 2004 and even stands promoted above the senior officers and posted as Additional Secretary in PWD.
The other major beneficiaries of government order No: 1429-GAD of 2011 are Arvind Kotwal former Deputy Secretary to CM Office, Abdul Rashid War posted in protocol department, Amit Sharma son of former MLA, Sheikh Arshad Ayoob former Deputy Secretary GAD, Shabnum Kambli and Leena Padha both former Deputy Secretary GAD.
While issuing the fresh order by GAD regarding the promotion of KAS officers, the rights of about 99 KAS officers have been infringed by the authorities who were at the helm of affairs. The aggrieved officers have already brought the matter into the notice of the Chief Minister, who turned deaf ear for obvious reasons. A question arises. Who will take action against the misdeeds of the GAD? Pertinent to mention, the GAD is headed by the Chief Minister.
