Court acquits alleged ISI agents

Jammu, Feb 3: Principal Sessions Judge Jammu today acquitted one Muddasar Ahmed Wani Pulwama and Dalwar Ahmed Banihal alleged ISI agents, as prosecution failed to established its case against the accused persons.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal today acquitted Muddasar Ahmed Wani s/o Habib Ullah wani r/o Harmain Tehsil Shopian, Pulwama, Dalwar Ahmed Naik S/o Mohd Ibrahim Naik R/o Harbari Neel, Banihal alleged ISI agent, as prosecution failed to established its case against the accused persons.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing both the sides observed that scanned the evidence on record which has emanated that no tangible evidence to connect the accused with the commission of offences has been procured by the prosecution. Counsel for the accused controverted with the PP on the point that prosecution witnesses produced in the court have not deposed even a single word against the accused persons.
A mere possession of recovered articles do not establish the accusation of the accused as per the prosecution case and thus, Court is satisfied that the prosecution has failed to establish the case against the accused and dismissed the challan. With the observations Court acquitted the accused from the charges framed against them.
According to the police case that that one Sukhvinder Kumar s/o Rattan Lal complainant made a verbal report in the police post Pouni Chak in the morning of 2.2.03 about spotting of two unknown person in suspicious circumstances who after being overpowered disclosed that at the instance of ISI of Pakistan they had gone to Pakistan for receiving training in dealing with arms and ammunition and after crossing Kukrian boarder in the night intervening 1st and 2nd Feb.2003 at the instance of ISI and have also brought with them the arms and ammunition alongwith Indian Currency notes which are kept hidden by them.
A case u/s 2/3 E A O,7/25 A.A against the accused were framed by the Court. (JNF)
