Fate of 6 expelled BJP MLAs yet to decide by the Speaker | | | Bashir Assad JAMMU, Feb 3: Though expelled from the basic membership of the part and the party decision conveyed to the Speaker of Jammu and Kashmir Legislative Assembly, the fate of 6 expelled BJP MLAs is yet to be decided on merits under J&K Legislative Members (Disqualification) Act. The six MLAs expelled from BJP on charges of cross voting while defying the party whip, according to sources, have submitted QDs, resolutions and bills to the assembly secretariat for the Budget Session commencing from February 20. The six expelled members which include Professor Chaman Lal Gupta, Gharu Ram Bhagat, Durga Das, Baldev Raj, Jagdish Sapolia, and Lal Chandd were expelled from the party on November 31, 2011 and the same was conveyed the Speaker Legislative Assembly to take action under the provisions of Members of J&K Legislative Assembly (Disqualification on Grounds of Defection) Law. It merits a mention here that the six MLAs were expelled from BJP on charges of cross voting in the Legislative Council polling. "They do not belong to our party, we have expelled them and now the decision of Hon'ble Speaker is awaited" said senior BJP leader Ashok Khajuria adding further that the six former members were expelled from the party under Rule 3 (6) of the Members of Jammu and Kashmir Legislative Assembly (Disqualification on Ground of Defection) Rules, 1987. "We conveyed the party decision to hon'ble speaker and he sought grounds of explanation from us, in compliance we furnished the same" Said new BJP legislature party leader Jugal Kishore adding that BJP was waiting for the final decision from the Speaker. Jugal Kishore said that High Court had issued show cause to the party on petition filed by the expelled legislators which we furnished to the court. "The decision of expelling the 6 MLAs was arrived at after following the due procedure and proceedings under Rule 3 (6) of the Members of Jammu and Kashmir Legislative Assembly (Disqualification on Ground of Defection) Rules, 1987, which authorise Legislature Party leader of the organisation concerned to take a decision on the disqualification of any of his own party member in the House," Jugal Kishore said, adding that copies of the decision had been sent to the Assembly Speaker and the Chief Election Commission of India as well. However, Congress which raised the issue of disqualification of the expelled BJP MLAs in the last assembly session in September 2011, have maintained silence over the issue this time. Congress party disrupted the proceedings of the house for a complete day in Srinagar demanding disqualification of six BJP MLAs from the house. Interestingly, the resolution moved by Independent MLA Er. Rashid seeking clemency to Parliament attack convict Afzal Guru could not be taken up for discussion on that day due to uproar in the house on the disqualification issue of expelled BJP MLAs. When asked why the congress party has maintained silence on the issue of disqualification 6 expelled BJP MLAs, Deputy Chief Minister Tara Chand refused to comment saying that future course of action on the issue will be decided once the session commences. |
