Omar, his henchmen file rebuttals in Haji yousuf mysterious death case

Srinagar, Feb 4 : While supreme court has rejected staying the commission of inquiry by retired judge , chief minister Omar Abdullah his "henchmen" including minister of state for home affairs Nasir Aslam
Wani and his political advisor Devinder Singh Rana and former PSO Shabir Ahmad have rebutted their charges by affidavits before the commission of inquiry headed by Justice H S Bedi.
Talib Shah son of deceased Haji Yousuf has accused chief minister Omar Abdullah his former PSO Shabir Ahmad, Nasir Sogami MOS home and CM's political advisor Devinder Rana as also IG Crime Raja Ajaz Ali for having tortured his father and NC activist Haji Syed Mohammad Yousuf at Omar's official residence on September 29, 2011 and thereafter subjected to further torture in the office of IG crime at Raj Bagh in Srinagar. The deceased died in the police hospital on September 30, 2011 after IG crime Raj shifted him to the hospital on September 29 evening.
The chief minister Omar Abdullah during his interviews with several private TV news channels admitted that he had summoned his party's worker Syed Yousuf to his residence to settle the issue of money he had taken from two other NC workers; Abdul Salam Reshi of Kokernag and Yousuf Bhat of Ganderbal . But he was immediately handed over to IG crime Raja Ajaz.
The deceased Haji Yousuf had disclosed that Omar Abdullah's father Farooq Abdullah had taken part of the money he had taken from Reshi and Bhat, an eye witness Salam Reshi had said in a private TV interview.
According to sources, chief minister Omar Abdullah , Nasir Aslam MOS home, Devinder Rana , PSO Shabir Ahmad and IG crime filed their statements before the commission last week soon after Talib Shah son of deceased stated before the commission that his father was tortured at CM's official residence on September 29, 2011 and thereafter, handed over to IG Raja Ajaz who also tortured Haji Yousuf resulting in his death .
The Defending themselves all the defendants including CM stated in separate affidavits states that they never tortured the NC worker Haji Yousuf., the sources said.
Even though supreme court on Friday rejected the plea of advocate Bhim singh for stopping the one man commission to inquire in to the mysterious death of Haji Yousuf , still the Apex court listed the case for final orders in the month of February.
Jammu and kashmir national Panthers Party MLA, Balwant Singh Mankotia through the petition is seeking investigation by CBI into the alleged custodial death of haji Mohammad Yousuf under mysterious circumstances on 30th September, 2011 . On Friday , the lawyer submitted that the commission of inquiry should be stopped from functioning in view of the pendency of petition before the SC.
Justice retired H S Bedi , who had come for the day last week admitted the affidavits of the trio ; Nasir Aslam Wani, Devinder singh Rana and IG crime Raj Ajaz Ali. However, Omar Abdullah and his former PSO Shabir Ahmad stayed away .
The Commission will meet on February 13 after the arrival of the judge , the sources said.
The Commission, had asked the people to submit any knowledge of the facts of the case in the form of an affidavit by January 31, 2012.
On November 18, the state government had appointed retired Supreme Court judge HS Bedi as the head of the one-man commission to probe into the death of 61-year-old Yousuf in police custody after reportedly having been tortured at CM's official residence.

Praying for early hearing for final disposal of the writ petition seeking probe by CBI , lawyer for the petitioner Bhim singh today submitted that there was every possibility the relevant record in connection with the entire episode including the material relating to the valid evidence maybe destroyed by the State Government since the government itself is a party to the entire tragedy including wrongful confinement of the deceased and his death in custody.
The petitioner has also filed a rejoinder containing rebuttal of the lies incorporated in the counter affidavit filed on behalf of the State.
The Director-General of Police and the Govt. of J&K through the Chief Secretary have admitted that the deceased was in custody at the time of his death. It has also been admitted by the Govt. that no (no) FIR
was lodged on the death Late Yousuf Haji. The Director-General of Police has also admitted that the police did not inform the only son of the deceased. The Govt. of J&K has admitted that Late Yusuf Haji
was taken to custody by the Inspector-General of Police in his official vehicle from the residence of the Chief Minister on 28th September, 2011 on the instructions of the Chief Minister, Gaurav Kumar Bansal, Advocate spokesman of Bhim singh in a statement today.
Jammu and Kashmir government has already constituted a one man commission headed by retire supreme court judge justice H S Bedi .
Yousuf was alleged to have had taken Rs.1.18crore from two NC workers in lieu for getting ministerial berth for Yousuf of Ganderbal and MLC seat for Reshi of kokarnag in Anantnag . Yousuf had reportedly
admitted before the chief minister of having received money from the duo but refused to pay it back as "he had given it to his father Farooq Abdullah"
