6 acquitted of charges for assisting militant outfits

JAMMU, Feb 4: Principal sessions judge Jang Bhadur Singh Jamwal has acquitted Tasadaq Hussian, Naseer Ahmed alias Doctor, Amjad Khan, Zafar Islam, Mohammad Hussian and Rukhsar Begum from the charges of assisting Jaish-e-Mohammad (JeM), Lashkar-e-Toiba (LeT), Hizbul Mujahideen (HM) and Harkat-ul-Ansar (HuA) by providing them ammunition, wireless sets, mobile phones and money. According to police case, on September 1, 2006, Nowshera police station received information that the accused in furtherance of a criminal conspiracy were involved in assisting the militant outfits by providing them ammunition, wireless sets, mobile phones and money.
On this information, FIR No 115/2006 was registered under sections 121, 121-A, 122, 123 and 120-B of RPC and 3 E A O.
In the course of investigation, searches were conducted in border areas of Lam and Laduka.
The accused were found sitting under suspicious circumstances near a spring in Laduka jungle. They were then apprehended and articles, including one pistol, live cartridges, mobile phones, sim cards, incriminating literature and Rs 1,95,000 in cash were recovered from the males.
During further investigation, a satellite phone was allegedlyrecovered on the disclosure of Rukhsana. On Naseer's disclosure, one RPGL alongwith a booster, 60 AK rounds and one grenade were recovered.
After the completion of investigation, challan was presented in the court.
After hearing the two sides, the judge observed that though there was not even an iota of evidence to establish that the accused had been assisting the foreign militant organisations.
He said the witnesses had failed to show their connectivity with the enemy or in anti-national activities.
A mare possession of the recovered articles did not establish the accusation of the accused as per the prosecution case and thus, the court was satisfied that the prosecution had failed to establish the case against the accused. Accordingly, the challan failed and the accused were acquitted of the charges framed against them.
