Gola Shah accuses IGP, others of harassing him by registering false cases against him | | | Asif Iqbal Naik Kishtwar, Feb 5: Ravinder Kumar Gupta alias Gola Shah, a property dealer, has filed a petition in the high court at Jammu, accusing IGP and other senior officers of harassing him by allegedly registering false cases against him. He was also said to have prepared a CD secretly in a sting operation. In it, a one of the police official was alleged to have made efforts to strike an underhand deal with him to drop cases against him. In another CD, an officer of SSP rank was alleged to have pressurised him to withdraw the case against an IGP, with an assurance to drop the cases against him. In the petition, Gola Shah stated that Madhu Aggarwal, wife of Rakesh Aggarwal of Gandhi Nagar, vide sale deeds dated May 9, 2001, May 23, 2001 and October 12, 2000, purchased 20 kanals, 5 kanals and 30 kanals of land at Chawadhi covered under survey No 658. Out of this land, she sold 5 plots of 18 marlas each. The petitioner is the attorney holder of proforma respondents in respect of the aforesaid land. He stated that Prabha Gupta, wife of Vijesh Gupta, and Vijesh Gupta, son of Barkat Ram of Pir Mitha, Jammu, claimed to have purchased 20 kanals of land in survey No 658 through different sale deeds but a controversy arose between the parties wherein each party claimed the right of land purchased by it, resulting in institution of suit by Madhu Aggarwal in the court of 1st additional munsiff (forest), Jammu. The court passed an order of status quo with regard to the possession of the suit land on September 6, 2007. During the pendency of the aforesaid suits between proforma respondents and private respondents, one Tarsem Singh Salaria also filed a complaint against some revenue officers on February 28, 2008, with IGP, crimes and railways, at Jammu. The complaint was later forwarded to SDPO whereupon FIR No 17/2008 came to be registered. The petitioner alleged that Madhu Affarwal, in connivance with one Ravinder Kumar and Subash, the then patwari halqa, had executed a sale deed in respect of the land which he had purchased under agreement to sell and power of attorney and accordingly sought legal action. Gola Shah alleged that IGP, once again started harassing and threatening him with the sole aim and object to divest the proforma respondents of their landed property for the petitioner. He alleged that on the basis of false and frivolous complaint, in order to remove him from the scene and settle scores with him, constituted a SIT for investigating a complaint regarding the land grabbing by someone else. He alleged that the said Police officer did not stop here but again manipulated by the filing of an FIR against him, bearing No 171/2011 at Gangyal police station under sections 341, 540 and 506 at the behest of Vikramjeet Singh, son of Dev Raj Singh of Green-Belt Park, Gandhi Nagar, and Gurvinder Singh, son of Dalip Singh of Bhour Camp, Gadigarh, in respect of land measuring 3 kanals 10 marlas covered under khasra No 645 min situated at Greater Kailash and intended to arrest him. Soon thereafter, he applied for bail in the competent court which was accordingly granted in his favour. The petitioner alleged that on seeing his nefarious designs frustrated, the officer raided his house at Greater Kailash recently in his absence along other police officers without any power and authority and threatened and harassed not only the women folk but also his son Rajat Jandial. A criminal complaint in this behalf was later filed by Rajat against the aforesaid police officers before the court of special mobile magistrate, Jammu, who directed SSP, Jammu, to personally probe into the matter and report to the court. Gola Shah stated that the IGP had developed ill will, malice, animosity and bias against him with the sole aim and object to effect his arrest in order to injure and harm his reputation and grab the above mentioned land. He stated that to substantiate bias, animosity and venom by the IGP towards him, substantial evidence was contained in the CD. He stated that on watching the contents of the CD, it would appear that the officer had deliberately, with criminal intention to frame him in false and fabricated cases, constituted SIT. |
