Court acquits sub-post master in corruption case | | | Early Times Report JAMMU, Feb 7: Special judge anti-corruption (CBI cases) B L Bhat today ordered to acquit sub-post master Bahadur Singh of the corruption charges framed against him by CBI. According to CBI case, on May 26, 2005, postal agent Mohinder Kumar filed a written complaint with CBI here, alleging therein that Bahadur Singh, posted as sub-post master at the cantonment branch of post office, was demanding Rs 800 from him for releasing his commission. A trap was then laid by CBI and Bahadur arrested while allegedly accepting the amount of bribe from the complainant. After the completion of investigation, a challan was presented in the court. After hearing both the sides, the judge observed that the investigation was not conducted fairly and no effort was made to ascertain the procedure relating to deposits made through agents and deduction of commission at source by the agents, eliminating any role of the post master in payment of commission. It was equally disturbing that the sanctioning authority, despite being aware of the procedure related to deposits made through agents entitling them to deduct commission at source, decided to accord sanction on mere asking of the CBI. Once the money sought to be deposited at the SB counter did not involve services of the accused, it was repugnant to reason as to how he could get an opportunity to exploit the complainant to deposit the investors' money without deducting commission at source, the judge said. The motive for the alleged crime was woefully lacking. So was the probability of accused having any leverage to extract/extort bribe from the complainant. It was in this context that the very prospect of demand for bribe emanating from accused had to be viewed as being improbable and unworthy of faith being reposed therein. That explained the lack of evidence in regard to accused having gone out to demand bribe from complainant immediately before the trap as put forth by IO in his testimony. The case of prosecution had to meet the inevitable fate of collapse. Resultantly the case was dismissed as not proved and accused was acquitted of the charges framed against him, the judge ordered.
