| HC directs Judicial Magistrate Ramnagar to hold enquiry | | Police Atrocities | |

Jammu, Feb 9: In a petition filed by Santosh Kumari who allegedly arrested and torture by the P/S Basantgarh in FIR, Justice JP Singh of J&K High Court Jammu Wing directed Judicial Magistrate Ramnagar to hold enquiry into the petitioner's allegations to ascertain true facts.
After hearing Adv HC Jalmeria, the Justice J P Singh observed that keeping in view the seriousness of the allegations leveled by the petitioner and deal their with it is considered appropriate to have the facts alleged by the petitioner ascertained on enquiry and directed Judicial Magistrate Ramnagar to hold enquiry into the petitioner's allegations to ascertain true facts. It is further ordered by the High Court that Judicial Magistrate to complete the enquiry within four months and to allow opportunity to the parties to led evidence and produce material in support of their respective defence.
This significant order passed by the High Court in a habeas corpus petition filed Santosh Kumari w/o Suresh Kumar Anganwari Worker and filed an affidavit in the Court in which she submitted that on October 29, 2010 two police personals of P/P Kot came to the house of deponent in the evening the and gave the message of SHO Basant Garh that SHO has called Santosh Kumari at Udhampur on November 1, 2010 to record her statement. On November 1, 2010 she along with her husband came there and she was taken in custody by the SHO Basant Garh and handed over to SHO Women Police Station Udhampur on the same day, her child two year old was separated from her. Her husband was asked to leave or else was threatened to be arrested. The woman was subject to torture by the SHO Women Cell Udhampur. Two of these seven persons were males and all these started her physically torture at 8:00 PM on November 1, 2010 and continued up to 2:00 AM Night, when she fell unconscious. According to victim's affidavit, the SHO Women Cell Udhampur till November 7, 2010 tortured her continued. It was submitted that she was remained in the custody of police from November 1, 2010 to November 10, 2010.
Worthwhile to mention here that as per the status report a dead body of male found lying the field on May 14, 2007 as the death of deceased suspicious and proceedings u/s 174 CrPC was initiated and November, 2010 Santosh Kumari was asked to appear in the police station for recording her statement.
