Recent judgement of the Hon'ble Supreme Court of India regarding fixation of time for granting sanction to prosecute corrupt public servants in the country by the government is indeed a welcome step. According to this order, a time limit of four months for deciding the question of sanction for prosecution of corrupt public servants has been fixed and sanction will be deemed granted if not decided within this time. This verdict removes the major bottleneck in the prosecution of public servants by any citizen against any act of corruption. This judgement has been widely acclaimed and is seen as landmark in the history of post independent India. The Apex Court, while allowing Janata Party President Subramaniam Swamy's petition against the Delhi High Court judgement refusing to direct the Prime Minister on his plea for prosecution of A. Raja, upholding the right of a private citizen to seek sanction for prosecution of a public servant for corruption has further strengthened the endavour against corruption by prescribing a limit of four months for deciding the matter. Such a judgement had become all the more necessary in view of the surfacing of more and more scandals involving thousands of crores of rupees and sitting over the matter of according sanction to deal with the corrupt elements in the government. It was observed that the corrupt servants were being shielded for political considerations and compulsions. In India, a very microscopic number of people belonging to high ranks have taken the menace of corruption as a social evil and displayed commitment to help the law of the land in early prosecution of the corrupt ones. A number of Union Ministers, State Chief Ministers, bureaucrats and other civil servants have been found involved in multi-crore scams. In many cases, there is documentary evidences against them but still sanction to prosecute them was being withheld deliberately due to lack of honesty and for political convenience. It is widely believed that the country's premier investigating agency-Central Bureau of Investigation (CBI) too has been manipulated and misused to the convenience of close ones of those who enjoy the political patronage of ruling elite. Some also observe that the CBI these days has become a toothless tiger and is working under as per the whims and wishes of senior politicians and bureaucrats. It has been further seen in last few years that the CBI had failed to provide justice, when in need and had meekly surrendered before the habitual law breakers. Now after a long time, it is hoped the judgement of Apex Court will strengthen the hands of the persons who are committed to fight against corruption. Further, there is need for a strong Lok Pal, under which CBI and other agencies must work. It is the only way to stop the misuse of investigating agencies and the effective mode to control the menace of all round prevailing corruption in the entire country. The nation is sill under shock on account of major scams that saw the light of the day and pertained to all sectors, including political, financial , corporate etc. Prominent scams like NRHM scam, spectrum allocation scam (also known as S-band scam), Goa mining scam, Bellary mining scam, 2G spectrum scam, Adarsh Housing Society scam, Commonwealth Games scam, LIC housing loan scam, Uttar Pradesh food grain scam, Andhra Pradesh Industrial Infrastructure Corporation scam, Indian Premier League scandal, Madhu Koda mining scam, Rice export scam, Orissa mining scam, Austral Coke scam, Cash for Vote Scandal, Hasan Ali black money controversy, Satyam scam, Army ration pilferage scam, Stamp paper scam Oil for food scam, Taj corridor scandal, HUDCO scam, Provident Fund (PF) scam, Kargil coffin scam, Ketan Parekh securities scam, UTI scam, Hawala scandal, Bihar fodder scam, Sukh Ram telecom equipment scandal, Sugar import scam, Harshad Mehta securities scam, Bofors Scandal and so many other scams related files are either biting dust in the investigating agencies or waiting nod for further action. |
