| Vigilance presents challan against then Dir Health, Ors | | Illegal appointments case | | Early Times Report
Jammu, Feb 13:Vigilance Organization Jammu today presented challan in the Court of Special Judge Anticorruption Jammu against then Director Health Services Dr MP Gupta (now Rtd), then SO Sham Lal Sharma (now Rtd) and Pawan Kumar then Senior Assistant and beneficiaries u/s 5(2) J&K PC Act 2006 and 420/120-B RPC.
According to the VOJ that allegations as per the complaint are that by virtue of the Govt order No 145-HMS of 1994 dated March 1, 19944 r/w Govt order NO 47 HME of 1997 March 31, 1997 some part time safaiwalas working in sub-centers of Health Dept so created under Plan Scheme were required to be regularized in a face manner. The then Director Health Services Jammu Dr R K Goel constituted a committee of Medical Officers to enquire into the alleged bungling committed in regularization of undeserving candidates in fraudulent manner.
The said committee of Medical Officers after conducting preliminary enquiry submitted a detailed factual report on July 31, 1998.
It was established that candidates regularized vide order dated April 25, 1997 and January 6, 1998 by then Director Health Services Jammu were in fact not existing on the rolls of Health Sub-Centers of Bishnah Block and instead had been regularized illegally floating the rules on the subject matter. The then Director Health Services Jammu furnish the report to VOJ. During the investigation the IO found that Dr. MP Gupta the then Director Health by abuse of his official position and criminal conspiracy with Sham Lal Sharma then SO & Pawan Kumar Bakshi then Sr Assistant both working in the office of Director Health Services Jammu without obtaining list of deserving part time safaiwalas from the Sub-Centers and without proper verification of his office record illegal issued regularization order.
During the further investigation VOJ found that one Yash Pal s/o Girdhari Lal r/o Vijaypur and Tarsem Lal s/o Dharam Chand r/o Mahal Shahan Samba were found working as Safaiwala in block bishnah. However, it has been established that during the investigation they have been appointed illegally as Safaiwalas ignoring the claim of deserving candidates. Dr MP Gupta then Director Health Services during the year 1998 had issued the regularization order of Two Safaiwalas without perusing the record and verifying the full particulars of appointees. The order was signed by the delinquent officer without consulting then BMO Bishnah. During the investigation, the IO found that the applications of both the appointees were allegedly forwarded by then MOS Health & Medical Education on the report of FSLs the signature of then MOS on the applications are fake and after completion of investigation presented challan in the Court of Special Judge Anticorruption.
