HC quashes PSA | | | early times report Jammu, Feb 14: Justice JP Singh today quashed detention under PSA of Ranjit Singh @ Manga alleged criminal who was detained by the order District Magistrate Kathua, found violative of the provisions of Article 22 (5) of the constitution of India and Section 13 of the J&K Public Safety Act 1978. The court after hearing Advocate Vikas Pankaj Sharma for the petitioner and whereas AAG Gagan Basotra for the State observed the detenue's detention ordered by District Magistrate, Kathua is, violative of the provisions of Article 22(5) of the Constitution of India and Section 13 of the Jammu and Kashmir Public Safety Act, 1978. against the detention to the Government. It, therefore, needs to be quashed. Earlier the counsel of detainee challenged the validity of the detention order is that non-supply of the Grounds of Detention and material relied upon by the Detaining Authority while recording satisfaction that the activities of the detenue were prejudicial and detrimental to the maintenance of Public Order and thus being violative of the provisions of Article 22(5) of the Constitution of India and Section 13 of the Jammu and Kashmir Public Safety Act, 1978, Ranjit Singh's detention is illegal.
