SHRC asks Govt to pay Rs 2 lakh as compensation to victim

JAMMU, Feb 14: State Human Right Commission (SHRC) has recommended Jammu and Kashmir state government to pay Rs 2 lakh to the victim girl who was kidnapped and raped by a Jammu and Kashmir Police constable and his two associates at Gulshan Ground in the year 2008.
SHRC took initiative following a complaint was registered with National Human Right Commission by relatives of the victim namely Suhas Chakma of Janak Puri, West Delhi who in his complaint alleged that one of their relative 17 years old girl was kidnapped by cop identified as Shabir Ahmed, who later took her in District Police Line, Gulshan Ground where with his two other associates gang raped her. He also mentioned that a case against the accused was registered with Police Station Gandhi Nagar under FIR NO 100/2008 u/s 263, 366A, 342, 367/09, 354 and 511 CrPC.
The relatives of the victim Suhas and others took up the matter with National Human Rights Commission (NHRC) which later took the matter with DGP Jammu and Kashmir Kuldip Khoda, who confirming the report said that after investigation the chargesheet was filed against the accused in the court of law.
On the basis of DGP report NHRC recommended Rs 2 lakh to the victim but the same was not accepted by the state government in the plea that NHRC has no jurisdiction to recommend the compensation to the state government and accordingly the complaint was forwarded to the SHRC. The matter was again put up before PHQ. Here, responding the letter forwarded from SHRC DGP Khoda once again confirmed the reports after getting detailed reports from SSP Jammu. Based on the report from PHQ SHRC recommended Rs 2 lakh to the state government. The order copy was forwarded to the Chief Secretary of the state Madhav Lal for further action.
SHRC took initiative following a complaint was registered with National Human Right Commission by relatives of the victim namely Suhas Chakma of Janak Puri,West Delhi and directed state government to pay compensation to victim.
