Court awards 1 yr RI to rural bank manager in trap case

jammu, Feb 15: Special judge anti-corruption (CBI Cases), B L Bhat today awarded one year rigorous imprisonment and a fine of Rs 10,000 to rural bank manager Ghar Chand who was caught redhanded while accepting bribe in 2007. A resident of ward No 12, Bishnah, he was manager of the bank's Rehal branch when he was trapped by CBI.
According to the CBI case, on March 16, 2007, one Teja Ram of Chak Fateh Khan, Bishnah, lodged a written complaint with CBI, alleging therein that Ghar had demanded a bribe of Rs 20,000 from him for sanctioning a personal loan of Rs 2 lakh in his favour.
However, when the complainant expressed his inability to arrange such a huge amount, Ghar asked him to pay Rs 3,000 as advance while the remaining Rs 17,000 would be deducted from the loan amount at the time of its disbursement.
On his complaint, CBI laid a trap in the house of accused and recovered the bribe money of Rs 3,000 from under the seat of sofa. He was then arrested and after the completion of investigation, challan was presented in the court.
Bhat observed that the prosecution had succeeded in establishing the demand of bribe by the accused as a public servant initially and at the time of the trap. The defence plea hadbeen rejected as false and fabricated. The presumption that the recovered money was demanded and accepted by the accused as bribe had not been rebutted by him which was proved to have been obtained by him as illegal gratification. The accused is accordingly found guilty and convicted of offence under section 161 of RPC and 5(2) read with 5(1) (d) of Prevention of Corruption Act.
The judge then sentenced the accused to one year rigorous imprisonment and imposed a fine of Rs 10,000 for each distinct offence.
The amount of fine, totaling Rs 20, 000, be deposited within 30 days failing which it would be realized from the estate of the accused. The judge ordered that the accused be lodged in district jail, Jammu, to serve the sentence.
